A RESOLUTION INDEMNIFYING THE STATE OF MINNESOTA
REGARDING A VARIANCE FROM MINNESOTA RULE 8820.9912
WHEREAS, the City is considering a Municipal State Aid improvement
on Arona Street (S.A.P. 124-101-02) and Albert Street
(S.A.P. 124-102-03); and
WHEREAS, the City deserves to permit parking on both sides of
Arona and Albert Streets with a street width of 34 feet;
and
WHEREAS, this street design with both side parking requires a
variance from Minnesota Rule 8820.9912;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF FALCON
HEIGHTS, MINNESOTA:
• The City of Falcon Heights indemnifies, saves and holds harm-
less, the State of Minnesota and all its agents and employees
of and from any and all claims, demands, action or causes
of actions of any nature or character arising out of or by
reason of, in any manner, the resconstruction of MSAS 101
(Arona Street) from Crawford Avenue to Roselawn Avenue and
on MSAS 102 (Albert Street) from Larpenteur Avenue to Garden
Avenue in any other manner than as in accordance with Minnesota
.Rules 8820.9912 and further agrees to defend at their sole
cost and expense any action or proceeding commenced for the
purpose of asserting any claim of whatsoever character arising
as a result of the granting of this variance.
