HomeMy WebLinkAboutCCRes_87-37Resolution No. R-87-37 RESOLUTION AUTHORIZING CITY OFFICIALS TO PROCEED WITH AN ACTION UNDER THE STATE HAZARDOUS AND SUBSTANDARD BUILDINGS ACT TO ABATE A HAZARDOUS CONDITION AT THE NORTHOME SHOPPING CENTER. WHEREAS, the City Council is authorized by the state Hazardous and Substandard Building Act, Minn. Stat. 463.161, to abate a hazardous building within the municipality by a court- enforced order, and WHEREAS, the City Fire Marshall has on repeated occasions during 1986-1987 notified the owners of the Northome Shopping Center (the "Center"), located at the southeast corner of Larpenteur and Snelling within Falcon Heights, that the Center • is in violation of the City Fire Code, especially in regard to the lack of a sprinkler system in the southeast corner of the basement, but no substantive action has been taken by the owners to correct the situation, and WHEREAS, the uncorrected fire code violations constitute a fire hazard, and WHEREAS, the City Council has determined that the abatement proceedings must be immediately instituted and prosecuted under the Act in order to protect the public safety and health. NOW, THEREFORE, BE IT RESOLVED by the City of Falcon Heights as follows: 1. The City finds on the basis of information provided by the City Fire Marshall which is on file with the Fire Marshall that the lack of a sprinkler system in the basement of the Center makes the Center a hazardous building within the meaning of the Act. 2. The City will begin abatement actions as authorized by • the Act against the owners, agents, tenants and lien holders of the Center to correct the hazardous condi- tions in the Center. 3.
