A RESOLUTION RELATING TO MORATORIUM ON HOME OCCUPATIONS
RESOLVED, That the City Council of the City of Falcon Heights has
recently had occasion to review the provisions of its Municipal Code
relating to planning and development and more specifically those
provisions regulating the conduct of businesses or occupations within
a home within residential districts of the City; and
RESOLVED, That the Council has questioned whether the current regulatory
scheme for said home occupations which includes confusing, multiple
provisions relating to conditional use permits, permitted accessory
uses and licenses, adequately reflects the Council's view of these
matters or whether the City's best interests would not be served by
a study designed to examine the regulation of such land uses within
the City; and
RESOLVED, That the City is mindful of the need for prompt action to
avoid any hardship on City residents which may result from any proposed
modification in the current zoning provisions relating to home occupations.
NOW, THEREFORE, be it Resolved by the City Council of the City of Falcon
Heights that a moratorium on authorizing home occupations in residential
districts of the City is established for a period of not longer than six (6)
months to allow for a comprehensive analysis of the subject of home occupations
contained in the Planning and Development Chapter of the City's Municipal
Code. The City's Zoning Administrator (Clerk Administrator) and City Attorney
shall forthwith examine the existing provisions of the Municipal Code relating
to home occupations as well as comparable provisions in the zoning codes of
other municipalities with an eye toward development a report to be submitted
to the City Council and Planning Commission not later than three (3) months from
the date hereof; and

BE IT FURTHER RESOLVED, that not later than six (6) months from the
date hereof, the City Council shall hold a public hearing to consider
any proposed amendments or additions to the planning and development
provisions of the City Code relating to home occupations.
