C O U N C I L R E S O L U T I O N
Date March 26, 1986
A RESOLUTION RELATING TO AMENDING RESOLUTION R-86-9 RELATING
TO EMPLOYEES
RESOLVED, That the City Council of the City of Falcon Heights
shall indemnify and provide a defense for any employee or officer,
whether elective or appointive, including individuals serving as:
(a) any member of the governing body of the named insured;
(b) any member of boards or commissions of the named insured;
(c) any elected or appointed official of the named insured;
(d) any employee of the named insured;
(e) any volunteer person or organization while acting on
behalf of any insured;
(f) any other authorized person or agent of the named insured
while acting on behalf of any insured, but excluding
independent contractors
against any court or administrative claim or demand, whether groundless or
otherwise, arising out of an alleged act or omission occurring in the
performance of duty. The City's obligation to indemnify and defend
City employees, officers and appointees does not apply in the case of
malfeasance in office or in the case of willful or wanton neglect of
duty.
