HomeMy WebLinkAboutCCRes_85-34No. R-85-34 CITY OF FALCON HEIGHTS C O U N C I L R E S O L U T I O N Date June 26, 1985 A RESOLUTION RELATING TO ORDERING HAMLINE AVENUE IMPROVEMENTS OF 1985 AND DIRECTING PREPARATION OF FINAL PLANS AND SPECIFICATIONS RESOLVED, That after due Notice of Public Hearing on the construction of storm sewer and street improvements for the City of Falcon Heights, Minnesota, hearing on said improvements was duly held and the Council heard all persons desiring to be heard on the matter and fully considered the same. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Falcon Heights, Minnesota as follows: 1. It is advisable, expedient and necessary that said improvements as described in the Notice of Hearing thereon be constructed, and the same are hereby ordered made. 2. The improvements described in said Notice of Hearing are hereby designated and shall be known as Hamline Avenue Improvements of 1985. 3. The consulting engineers, Bonestroo, Rosene, Anderlick & Associates, are hereby directed to prepare final plans and specifications for said improvements. 4. The City Council shall let the contract for all or part of the work for said improvements or order all or part of the work done by day labor or otherwise as authorized by Minnesota Statutes, Section 429.041, Subdivision 2, within one year of the date of this resolution ordering said improvements. EXTRACT OF .MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF FALCON HEIGHTS, MINNESOTA HELD: JUNE 26, 1985 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Falcon Heights, Minnesota, was duly called and held at the City Hall in said City on the 26th day of June, 1985, at x':00 P.M. The following members were present: Mayor Eggert, Baldwin, Ciernia, Hard and Chenoweth and the following were absent: None. The meeting was held pursuant to resolution adopted April 24 1985, calling a public hearing on the proposed Hamliner~~en~e Improvements of 1985 in said City, as more par- ticularly described in the Notice of a Public Hearing ordered at said April 24 1985 meeting, a copy of which is attached . hereto. The Clerk-Administrator presented affidavits showing the due publication and mailing of the Notices of Hearing and the Mayor announced that the Council would hear all persons who cared to be heard for or against the improvements as outlined in the Notice of Hearing. Mr. Chenoweth then explained the cash flow :Formula. The matter was interrupted for the public hearing ~ scheduled for '1:30 P.M. Mayor Eggert opened the Public Hearing on Amendment of Tax Increment Financing Plan for 1666 Coffman and presented the Affidavit of Publication. Attorney Van de North reviewed and commented on the amended plan which was prepared at the request of Attorney Mary Ipel. There being no one wishing to be heard, Mayor Eggert closed the Public Hearing at .7:43 P.M., and moved the adoption of Resolution R-85-31. The motion was seconded by Council- member Hard and upon a vote being taken, passed unanimously. RESOLUTION R-85-31 A RESOLUTION APPROVING THE MODIFIED TAX INCREMENT FINANCING PLAN FOR DEVELOPMENT DISTRICT N0. 1 Mayor Eggert moved, seconded by Councilmember Ciernia, that Resolution R-85-32 be adopted setting a Public Hearing on Reduction of Economic Development District No. 1 Within Development District No. 1 for 7:10 P.M., July 24, 1985, and a Public Hearing on Creation of Tax Increment District No. 3 Within Development District No. 1 for 7:15 P.M., July 24, 1985, and authorize publication•of the same. Motion carried unanimously. RESOLUTION R-85-32 RESOLUTION CALLING FOR PUBLIC HEARING ON THE REDUCTION OF ECONOMIC DEVELOPMENT DISTRICT N0. 1 WITHIN DEVELOPMENT DISTRICT N0. 1 AND THE CREATION OF TAX INCREMENT FINANCING DISTRICT N0. 1-3 WITHIN DEVELOPMENT DISTRICT NO. 1 Council again resumed discussion of the Tatum Street improvements and Mayor Eggert read into the record written comments made by persons who submitted the information during the two day period following the Public Hearing held June 12, 1985 (copies of which are on file in the Clerk's Office). Council discussed at length the value of curb and gutter in street reconstruction (adds 10 years of life to the street and snow plows do not tear up boulevard area, .the advantage of bidding the project with the Coffman project, and completion date - October, 1985). Councilmember Chenoweth moved, seconded by Councilmember Ciernia, that Resolution R-85-33 be adopted. Motion carried unanimously. RESOLUTION R-85-33 A RESOLUTION ORDERING TATUM STREET IMPROVEMENTS OF 1985 AND DIRECTING PREPARATION OF FINAL PLANS AND SPECIFICATIONS Councilmember Baldwin arrives. At 8:00 P.M. Mayor Eggert opened the Public Hearing on the proposed Hamline Avenue improvements and presented the Affidavits of Publication and Mailing. Engineer Schunicht presented an overview of the proposed project and explained the procedure required by State Statute. He also explained the need to reconstruct the alley running from Albert PUBLIC HEARING ON COFFMAN TIF AMENDMENT &:30 P.M. RESOLUTION R-85-31 RESOLUTION R-85-32 TATUM STREET IMPROVEMENT DISCUSSION RESUMED RESOLUTION R-85-33 COUNCIL- MEMBER BALDWIN ARRIVES HEARING ON PROPOSED HAMLINE AVE IMPROVEMENT S MINUTES • REGULAR CITY COUNCIL MEETING/PUBLIC HEARINGS JUNE 26, 1985 page 3 • to Hamline between Larpenteur and California. Mr. Schunicht stressed the fact that the project will be funded by Falcon Heights, St. Paul, Ramsey County, and Minnesota State Aid. Jay McNabb, Palmer and Zweber, the law firm representing Robert Blomberg, owner of the property at 1579-1583 Hamline, read a letter dated June 20, 1985 listing Mr. Blomberg's concerns (a copy of which is on file in the Clerk's Office). One main conern was access to the business during construction and whether or not one driveway could be kept open. Engineer Schunicht will contact Mr. Blomberg and discuss the matter. Mrs. Robert Dobin, 1362 West Larpenteur, commented on the fact that when Albert Street was torn up, the Engineer said the alley between Larpenteur and California from Albert to Hamline, did not need drainage, now they are being told it is necessary. The Engineer explained that Albert is higher than the alley so the alley must drain to Hamline. Mrs. Dobin also wanted to know where they could park during construction when they are not allowed to park on Larpenteur. Some suggestions were made-- perhaps permit parking on Albert or Larpenteur, or the residents could park on California. Engineer Schunicht explained that it would not be torn up for more than one week. Marvin DeMartino, 1345 West California, said that the County Engineer had told him that Falcon Heights had requested the Hamline improvements (in .April of 1980, the City did adopt a resolution requesting such ' improvements). Mr. DeMartino asked if MSA funds were to be used to which Mr. Schunicht replied that they were. Mr. DeMartino expressed the opinion that it was not feasible to repair only a four block area of Hamline when five miles need repair. Mr. Schunicht explained that other areas will be repaired when funds are available. Robert L. Dobin, 1362 West Larpenteur, asked why the alley was not repaired when Albert Street was torn up. He also commented on the fact that the Engineer had stated there was no need for storm sewer in the alley, the reconstruction of Albert Street would solve the problem. Mr. Schunicht again explained that the alley drains to Hamline, and guaranteed with the proposed improvement that the alley will drain properly. D. Thornquist, 1368 West Larpenteur, asked if the whole lot is being assessed for storm sewer and the Engineer explained the drainage area which would be assessed. Mr. Thornquist questioned whether or not the alley would be done properly to specifications or level it off and patch as it was done last time. Mr. Schunicht assured that it would be completely reconstructed (a 20 year alley) and would be capable of handling garbage trucks. John Ringus, 1367 West California, objecting to paying for storm drainage as many years ago he had petitioned and paid for curb and gutters so there would be drainage, and felt there was nothing wrong with the storm sewer system. Engineer Schunicht explained that the existing storm sewer has collapsed several times, was construction piecemeal, • and after 30 years streets and sewers do require reconstruction. Mr. Ringus also commented on the alley construction in 1950 which lasted two years before breaking up, and felt it had not been done properly, there was not proper upkeep. Mr. Ringus felt that since it had been bad for 30 years, he could stand it a few more years. JAY MCNABB REPRESENTING BOB BLOMBERG 1579-1583 HAMLINE MRS. LARPENTEU JOHN RINGUS, 1367 WEST CALIFORNIA MINUTES REGU~.AR CITY COUNCIL MEETING/PUBLIC HEARINGS JUNE 26, 1985 PAGE 4 Ed Ahlberg, 1340 West Idaho, asked if Hamline would be widened to which Engineer Schunicht replied it would be narrowed up in some places, widened in others to make the street in line, would be 44 to 48 feet i wide, and would look much the same as it does now. Mr. Ahlberg also commented on the flooding of his alley. ED AHLBERG 1340 WEST IDAHO Mrs. Wicklund, 1359 West Iowa, had arrived late and asked that the Engineer MRS. explain "collector street", and expressed concern that they would have WICKLUND, trouble entering their garage while the street is under construction. 1359 WEST Engineer Schunicht explained that it was possible the alley would be IOWA inaccessible for a limited period of time. Marvin DeMartino, 1345 West California, was concerned about the manner in which his driveway would be replaced and Engineer Schunicht agreed to discuss the plans with Mr. DeMartino. In reply to a question from the audience, Mr. Schunicht explained that the assessment hearing could be held in the fall of 1985 and assessments would go on the 1986 taxes, or could be paid in 1986 and placed on 1987 taxes. Councilmember Chenoweth stated that if the project is assessed this year, it would save the City interest costs and, therefore, reduce the assessments. There being no others wishing to be heard, Mayor Eggert closed the Public Hearing at 9:21 P.M. • Councilmember Ciernia felt that since the City had abated storm sewer assessments for others in that area, that it would be fair to do the same for the residents in this storm drainage area. He, personally, favored abatement of storm sewer charges, and questioned some residents being charged for the collector street and the street in front of the house. Engineer Schunicht replied that no one is being assessed twice. Councilmember Baldwin agreed with Councilmember Ciernia that storm sewers should not be assessed when applying to reconstruction. It was pointed out that others in the community had been assessed for storm sewer and the assessment policy adopted by Council provides for assessment of storm sewers. Council discussed the items at length -- both of the items of whether or not the assessment policy should be amended. Mayor Eggert felt that the people still have the benefit of the service and he would prefer to see them assessed. Councilmember Hard felt it would be unfair as other neighborhoods had been assessed and paid for storm sewers,. and Councilmember Chenoweth stated if there is to be a policy of not assessing the City could consider making the entire City a storm sewer district, however, he felt the present policy should be applied. Councilmember Ciernia moved, seconded by Councilmember Baldwin, that the storm sewer assessment be deleted from the project, the cost approximately $57,000, to be paid from MSA funds. Upon a vote being taken, the following voted in favor thereof: Councilmembers Ciernia, and Baldwin, and the follow- ing voted against the same: Mayor Eggert, Councilmembers Hard and Chenoweth. Motion failed. MARVIN DEMARTINO, 1345 WEST CALIFORNIA PUBLIC HEARING CLOSED COUNCIL DISCUSSION Mayor Eggert moved, seconded by Councilmember Hard, that Resolution R-85-34 be adopted authorizing Ramsey County to proceed with the project. Upon a vote being taken., the following voted in favor thereof:. Mayor Eggert, I ~ NOTICE OF PUBLIC HEARING ON IMPROVEMENTS TO WHOM IT MAY CONCERN: DATE AND NOTICE IS HEREBY GIVEN, that at 8=0© P•m• on TIME June 26, 1985 at City Hall, 2077 West Larpenteur Avenue, Falcon Heights, Minnesota a public hearing will be held to consider improvements to Hamline Avenue from Hoyt Avenue to Larpenteur Avenue. IMPROVEMENTS Such improvements shall include the installation of storm sewer and street reconstruction on Hamline Avenue and the installation of storm sewer and reconstruction of the Larpenteur/ California Alley. COST The estimated cost to Falcon Heights of the improvements is $145,900. The area to be assessed includes the following parcels: AREA PROPOSED Cable's Hamline Heights Addition, Block 8, TO BE ASSESSED Lots 1 - 28, Northome Addition Block 1, Lots 1 - 25; Block 4, Lots 1 - 22; Block 5.
