HomeMy WebLinkAboutCCRes_84-31• RESOLUTION 84-31 A RESOLUTION ADOPTING THE REASSESSMENT ROLL FOR 1982 NORTHOME IMPROVEMENTS, CANCELLING PRIOR ASSESSMENTS AND DIRECTING REFUNDS Pursuant to legal notice thereof, a public hearing on the subject of the above-captioned Resolution was held at City Hall, in the City of Falcon Heights, Minnesota on September 5, 1984, at 8:00 p.m. in the course of a regularly scheduled City Council meeting which had convened at 7:00. p.m. The following members of the Falcon Heights City Council were present: Mayor Eggert, Councilmembers Chestovich, Cernia, Hard and Baldwin,-and the following were absent: None. Mayor Eggert moved the adoption of the Resolution captioned above incorporating the particulars more fully stated as follows: • 1. WHEREAS,. the Council directed a reassessment of the costs relating to the 1982 improvements of Albert and Pascal Streets within the City following appeals of the original assess- ments by certain property owners and upon the advice of the City Attorney regarding potential defects in said original assessments; and 2. WHEREAS, the City Council has determined that each lot, piece and parcel of property within the area to be assessed is benefited in the amount of the respective assessments levied against it in accordance with the reassessment .roll prepared by the City Engineer; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Falcon Heights, Minnesota as follows: 1. The original assessment roll for the 1982 Pascal and Albert Street improvements is cancelled; and, the Clerk- Administrator is hereby authorized and directed to apply any amounts previously paid by property owners pursuant to said assessments as a credit against the reassessments being ordered herein. In the event the reassessment results in reduced assessments, refunds shall be made, without interest, to affected property owners. •~ • 2. The reassessment roll is hereby adopted and said assessments may be paid in cash, without interest, if paid within thirty days of September 5, 1984, or may be paid in eight equal annual installments in the same time and manner as the payment of real estate taxes with interest at the rate of lOpercent per annum from September 5, 1984, to December 31, in the year in which the first payment is payable to be added to the first installment and one years interest on the remaining balance to be added to each subsequent. installment; PROVIDED, HOWEVER, that any property owner may pay the entire unpaid balance of the assessment against his property at any time with interest to December 31 of the year in which said payment is made. 3. The Clerk-Administrator is hereby authorized and directed to certify a copy of the reassessments and a copy of this Resolution to the County Auditor of the County of Ramsey to be extended on the proper tax lists of the County for col- lection with other real estate. taxes in and for the City.
