CITY OF FALCON HEIGHTS, MIP7NESOTA HELD: SEPTEMBER 19, 1984 Pursuant to due call and notice thereof, a public hearing of the City Council of the City of Falcon Heights, Ramsey County, Minnesota, was duly held at 7:15 o'clock p.m. The following members of the Council were present: Mayor Eggert, Councilmembers Hard, Baldwin, Ciernia and Cnestovich and the following were absent: none. • 2~2ember Mayor Eggert introduced the following resolution and moved its .adoption: RESOLUTIOPd 5~~- 32 RESOLUTION ADOPTING DEVELOPMENT PLAN AND TAX INCREMENT FINANCING PLAN, DECLARING PUBLIC PURPOSE, REQUESTING CERTIFICATION OF ORIGINAL ' ASSESSED VALUE, PROVIDING FOR FILING, ADMINISTRATION - ~VHEREA5 A. The City of Falcon Heights has formed a development district known as Development District No. 2 on July 11, 1984. It has been purposed that the City of Falcon Heights create a tax increment financing district within Development District No. 2 and adopt a development program and tax increment. financing plan therefor under the provisions of Minnesota Statutes, Section 273.71 to 273.78 and Chapter 472 (collectively the "Act"). B. In accordance with the provisions of the Act, the City Council has consulted with the Planning Commission and the members of the Board of Commissioners of Ramsey County and the School Board of_ Independent Sc'nool District No. 623 and Special. Intermediate School Board No. 916; • C. Said proposal has heretofore been given • preliminary approval by the City Council; and D. A public hearing was duly held on said proposal on this date (September 19, 1984) in accordance with the provisions of the Act; NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Falcon Heights as follows: 1. Development Program. The development program as set forth in the report entitled "Development District No. 2 July 11, 1984 and the Tax Increment Financing Plan for Redevelopment District No. 1" and dated September 19, 1984, a copy of which is on file in the office of the City Clerk, is adopted as the Development Program for Development District No. 2. 2. Tax Increment Finance District No. 1. There is established in the City of Falcon Heights within Development District Na. 2 a tax increment finance district to be known as "Tax Increment Finance District No. l," the initial boundaries of which are fixed and determined as shown on the attached Exhibit A incorporated herein by reference. 3. Tax Increment Financing Plan. The tax increment financing plan as set forth in said report is adopted as the • Tax Increment Financing Plan for Tax Increrent Finance District No. 1, and the City Council makes the following findings: (a) Tax Increment Finance District No. 1 is a redevelopment district as defined in Minnesota Statutes, Section 273.73, the specific basis for such determination being: The Tax Increment Finance District i1o. 1 is an area of the City of Falcon Heights where 70 percent of the parcels of such district are occupied by buildings, streets, utilities or other improvements and more than 50 percent of the building, not including outbuildings, are structurally substandard to a degree requiring su'pstantial renovation or clearance. The reasons supporting this finding are that a fire destroyed the. principal business in the District over two years ago. The other buildings adjacent to a now vacant lot have deteoriated to such an extent that new facades, roofs, and interior repair • essential for an appropriate use for building to contribute to the City's base and provide a vital business intersection for the City of Falcon would be th e economic Heights. (b) The proposed redevelopment in the opinion of the City Council, would not occur solely through private investment within the reasonably foreseeable future and therefore the use of tax increment financing is deemed necessary. The reasons supporting this finding are that in over two years since a fire destroyed the largest business in the district no development has occurred. The buildings remaining are substandard and must be upgraded or cleared to generate any new business or revenues for the City. (c) The Tax Increment Financing Plan conforms to the general plan for development or redevelopment of the City of Falcon Heights as a whole. The reasons supporting this finding are that the proposed retail/office project conforms with the Master Plan for t'ne City of Falcon Heights. The district is the hub of the City of Falcon Heights business zone which is in need of revitalizing.. It is anticipated that this project is the first • phase of anticipated comprehensive redevelopment of the area. (d) The Tax Increment Financing Plan will afford maximum opportunity, consistent with the sound needs of the City of Falcon Heights as a whole, for the development ar redevelopment of Tax Increment Finance District No. 1 by private enterprise. The reasons supporting this finding are that since a fire destroyed the principal retail business in the District two years ago, this principal business district and major intersection of the City of Falcon Heights has remained a blighted area. The developer has indicated an interest in pursuing a development but such development is dependent upon. the Tax Increment Financing Plan. The development is critical to the first phase of anticipated, comprehensive development of the entire intersection. It is the first step and is essential to the on-going interest and development for the entire area. (e) The City of Falcon Heights elects the method of tax increment computation set forth in Minnesota Statutes, Section 273.76, Subd. 3, clause a • 4• Public Pur ose. The adoption of the Development • Program and Tax Increment Financing Plan for Development District No. 2 and Tax Increment Finance District No. 1 conform in all respects to the requirements of the Act and will help fulfill a need to develop an area of the City which is already built up to provide employment opportunities to improve the tax base and to improve the general economy of the State and .thereby serves a public purpose. 5• Certification. The Auditor of Ramsey County is requested to certify the original assessed value of Tax Increment Finance District No. 1 as described in the Tax Increment Financing Plan, and to certify in each year thereafter the amount by which the original assessed value has increased or decreased in accordance with the Act; and the City Clerk is authorized and directed to fort'nwith transmit this request to the County Auditor in such form and content as the Auditor may specify, together with a list of all properties within Tax Incre--nent Finance District No. I for which building permits have been issued during the 18 months immediately preceding the adoption of this Resolution. 6. Filing. The City Clerk is further authorized and directed to file a copy of the Tax Increment Financing Plan for Tax Increment Finance District No. 1 with the Minnesota Energy and Economic Development Authority. • 7. Administration. The administrator of Develo ment District No. 2 is assigned to the Clerk-Administration whop shall from time to time be granted such powers and duties pursuant to Minnesota Statutes, Sections 472A.09 and 472A.10 as the City Council may deem appropriate. The motion for the adoption of the foregping resolution was duly seconded by member Chestovich and upon vote being taken thereon, the following voted in favor thereof: riayor Eggert, Councilmembers Hard, Baldwin and Chestovich, and the following voted against t'ne same: Councilmember Ciernia.
