HomeMy WebLinkAboutCCRes_82-14CITY OF FALCON HEIGHTS Pursuant to due call and notice thereof, a regular meeting of the City Council of Falcon Heights, Minnesota was held on the 14th day of April, 1982. The following members were present: Mayor Warkentien, Council- members Larson, Ciernia and Chestovich , and the following were absent: Councilmember Eggert. Mayor Warkentien introduced the following resolution and moved its adoption: RESOLUTION 82-14 A RESOLUTION AUTHORIZING WITHHOLDING AND ESCROWING OF CONTROVERTED PAYMENTS TO METROPOLITAN WASTE CONTROL COMMISSION WHEREAS, the Metropolitan Council on the 26th day of February, 1981, directed the Metropolitan Waste Control Commission to submit a sewage treatment cost allocation attributable to certain lake overflows metered from Lakes Beaver, Como, McCarrons and Phalen; and WHEREAS, said Council on the 6th day of October, 1981, deter- mined to allocate a certain portion of the sewage treatment cost allegedly attributable to said lake overflows to the eight (8) suburban communities of the cities of Falcon Heights, Little Canada, Maplewood, North St. Paul, • Oakdale, Roseville, Vadnais Heights and White Bear Lake and directed said Commission to make charges accordingly; and WHEREAS, said eight (8) suburban communities have instituted proceedings filed in Ramsey County District Court for relief from said charges assessed for treatment of-lake overflows. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FALCONfEIGHTS 1. That the City Clerk Administrator be and hereby is authorized to withhold payment to the Metropolitan Waste Control Commission of those sums charged for the treatment', of lake overflows; and 2. That the sums withheld attributable to said treatment of lake overflows be set aside and deposited in an interest bearing account pending further direction of this Council and/or Order of the District Court. The foregoing resolution was duly seconded by Councilmember Larson and upon a vote being taken the following voted in favor thereofc Mayer.
