EXTRACT OF MINUTES OF MEETING OF THE
CITY COUNCIL OF THE CITY
OF FALCON HEIGHTS, MINNESOTA
HELD: JULY 27, 1983
Pursuant to due call and notice thereof, a regular
meeting of the City Council of the City of Falcon Heights,
Ramsey County, Minnesota, was duly held at 7:30 o'clock p.m.
The following members of the Council were present:
Chestovich, Eggert, Warkentien, Larson and
Ci rnia;
and the followin were absent:

none.
Member Ciernia introduced the following resolution
and moved its adoption:
RESOLUTION N0. 83-24
RESOLUTION FORMING DEVELOPMENT DISTRICT,
ADOPTING DEVELOPMENT PROGRAM AND
TAX INCREMENT FINANCING PLAN,
DECLARING PUBLIC PURPOSE,
REQUESTING CERTIFICATION OF ORIGINAL
ASSESSED VALUE, PROVIDING FOR FILING,
ADMINISTRATION, AND SPECIAL ACCOUNT
WHEREAS:
A. It has been proposed that the City of Falcon
Heights form a development district and adopt a development
program and tax increment financing plan therefor under the
provisions of Minnesota Statutes, Section 273.71 to 273.78 and
Chapter 472 (collectively the "Act").
B. In accordance with the provisions of the Act, the
City Council has consulted with the Planning. Commission and the
members of the Board of Commissioners of Ramsey County and the
School Board of Independent School District No. 623;

C. Said proposal has heretofore been given
preliminary approval by the City Council; and
• D. A public hearing was duly held on said proposal
on April 20, 1983 in accordance with the provisions of the Act;
NOW THEREFORE, BE IT RESOLVED, by the City Council of
the City of Falcon Heights as follows:
1. Development District. There has heretofore been
established in the City of Falcon Heights a development
district known as "Development District No. 1". This
development district is hereby enlarged and the boundaries are
fixed and determined as shown on the attached Exhibit A
incorporated herein by reference.
2. Development Program. The development program as
set forth in the report entitled "Development District No. 1
(as amended) and Tax Increment Financing Plan for an Economic
Development District No. 1" and dated April 9, 1983, a copy of
which is on file in the office of the City Clerk, is adopted as
the Development Program for Development District No. 1.
3. Tax Increment Financin Plan. The tax increment
financing plan as set orth xn said report is adopted as the
Tax Increment Financing Plan for Development District No. 1,
and the City Council makes the following findings:
• ___ (a) Development District No. 1 is an economic
development project as defined in Minnesota Statutes, Section
273.73, the specific basis for such determination being:
The development district improvements are a
project which will preserve and enhance the
tax base of the City. Included is the
construction of storm water management
facilities which will make possible
residential and commercial development of
property now vacant and not served by these
necessary public improvements..
(b) The Development Program for Development District
No. 1, in the opinion of the City Council, would not occur
solely through private investment within the reasonably
foreseeable future and therefore the use of tax increment

financing is deemed necessary. The land has not been developed
in the past, nor will it be developed in the foreseeable future
due to the lack of private investment capital to provide proper
drainage for the area or to extend municipal facilities. For
example the cost of privately financing the storm water system
could not be feasibly recovered by developers.
(c) The Tax Increment Financing Plan conforms to the
general plan for development or redevelopment of the City of
Falcon Heights as a whole by encouraging the highest and best
use of vacant, but unusable land in the City.
(d) .The Tax Increment Financing Plan will afford
maximum opportunity, consistent with the sound needs of the
City of Falcon Heights as a whole, for the development or
redevelopment of Development District No. I by private
enterprise.. Tt will promote and secure the prompt development
of property in the Development District with a minimal adverse
impact on the environment, provide additional employment
opportunities within the Development District for residents of
the City and the surrounding area; and enhance the value of
previously developed areas of the community.
(e) The City of Falcon Heights elects the method of
tax increment computation set forth in Minnesota Statutes,
Section 273.76, Subd. 3, clause (a).
• 4. Public Purpose. The formation of Development
District No. 1 and adoption of~the Development Program and Tax,
Increment Financing Plan conform in all respects to the
requirements of the Act and will .help fulfill a-need to develop
an area of the City which is already built up to provide
employment opportunities to improve the tax base and to improve
the general economy of the State and thereby serves a public
purpose.
5. Certification. The Auditor of Ramsey County is
requested to certify the original assessed value of Development
District No. 1 as described in the Tax Increment Financing
Plan, and to certify in each year thereafter the amount by
which the original assessed value has increased or decreased in
accordance with the Act; and the City Clerk is authorized and
directed to forthwith transmit this request to the County
Auditor in such form and content as the Auditor may specify,
together with a list of all properties within Development.
District No. 1 for which building permits have been issued
during the 18 months immediately preceding the adoption of this
Resolution.
6. Special Account. There is created a special
account designated "Development District No. 1 Tax Increment
Account" to be held by the City Treasurer separate and apart
from all other accounts of the City into which shall be
credited all tax increments received with respect to
Development District No. 1 to be used in accordance with the
Act and the Tax Increment Financing Plan.

7. Filing. The City Clerk is further authorized and
directed to file a copy of the Tax Increment Financing Plan for
Development District No. 1 with. the Department of Energy and
Economic Development.
8. Administration. The administration of
Development District No. l is assigned to the
Clerk-Administrator who shall from time to time be granted such
powers and duties pursuant to Minnesota Statutes, Sections
472A.09 and 472A.10 as the City Council may deem appropriate.
The motion for the adoption. of the foregoing
resolution was duly seconded by member Eggert and upon vote
being taken thereon, the following voted in favor thereof:
Chestovich
Eggert
Warkentien
Larson
Ciernia
and the following voted against the same:
none.
Whereupon said resolution was declared duly passed
and adopted.
