Pursuant to due call and notice thereof, a regular meeting of the
City Council of the City of Falcon Heights, Minnesota was duly held at the
City Hall in said City on the 27th day of July, 1983.
The following members were present: Mayor Warkentien, Council-
members Larson, Ciernia, Chestovich and Eggert, and the following were
absent: None.

Mayor Warkentien introduced the following resolution and moved its
RESOLUTION 83-27
RESOLUTION AUTHORIZING ATTORNEY JOHN BANNIGAN
TO MOVE THE RAMSEY COUNTY DISTRICT COURT FOR
AMENDED FINDINGS IN THE MATTER PENDING AGAINST
THE METROPOLITAN COUNCIL PURUSANT TO RULE 59
OF THE MINNESOTA RULES OF CIVIL PROCEDURES
WHEREAS, the City. Council has met with. its Special Counsel, John
Bannigan, regarding the status of the lawsuit pending in Ramsey County District
Court involving the City as well as other adjacant municipalities and the Metro-
politan Council over the cost of managing storm water runoff; and
WHEREAS, Mr. Bannigan has reported the adverse decision of Judge Harold
Schultz in the above-referenced matter; and
• WHEREAS, Mr. Bannigan has determined that there may be facts relating
to the City of Falcon Heights which distinguish it from other involved communities
which he recommends be presented to the Court in the form of a Motion for Amended
Findings;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Falcon
Heights, that St. Paul Attorney John Bannigan be authorized to do the necessary
research, prepare appropriate papers and do other things necessary to move the
Ramsey County District Court to amend its findings in the recently decised law-
suit against the Metropolitan Council so as to accord more favorable treatment
to the City of Falcon Heights on the issue of sharing the costs of storm water
management.
The motion for the foregoing resolution was seconded by Councilmember
Larson, and upon a vote being taken the following voted in favor thereof: Mayor
Warkentien, Councilmembers Larson, Ciernia, Chestovich and Eggert, and the follow-
ing voted against the same: None.
