Pursuant to due call and. notice thereof, a Special Meeting of the City
Council of the City of Falcon Heights, Minnesota was held on the 30th day of
November, 1983.
The following members were present: Mayor Warkentien, Councilmembers
Chestovich, Eggert, Larson and Ciernia, and the following. were absent: None.
Mayor Warkentien introduced the following resolution and moved its
adoption:
RESOLUTION 83-42
A RESOLUTION APPOINTING THOMAS HUGHES, ATTORNEY AT
LAW, AS SPECIAL PROSECUTOR FOR THE CITY OF FALCON
HEIGHTS
WHEREAS, The City of Falcon Heights is required to prosecute all
Ordinance Violations, which occur within the City limits; and
WHEREAS, the City of Falcon Heights has retained Mr. Jerry Filler as
Prosecutor to prosecute said matters; and
WHEREAS, from time to time Mr. Filla and the City's Attorneys, Briggs and
. Morgan, may have conflicts of interest which prohibit their prosecuting a
case; and
WHEREAS, it is necessary for the City to expedite processing of all such
prosecutions;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Falcon
Heights that:
1. The City hereby appoints Mr. Thomas Hughes, Attorney at Law,
770 University Avenue, St. Paul, Minnesota, as Special
Prosecutor on terms which are mutually agreeable to Mr.
Hughes and the City.
2. The City Administrator is empowered from time to time to
assign to Mr, Hughes such matters in which the existing City
Prosecutor or the City Attorney may have a conflict.
3. Nothing herein shall prohibit the Council from terminating
this Agreement by notice to Mr. Hughes and/or assigning
matters to any other special prosecutors in the sole
discretion of the City.
The motion for the adoption of the foregoing resolution was duly seconded

in favor thereof: Mayor Warkentien,
and Ciernia and the following voted
WHEREUPON, the resolution was declared duly passed and adopted.

NOTICE OF PUBLIC HEARING
ON A PROPOSAL FOR A COMMERCIAL
FACILITIES DEVELOPMENT PROJECT
Notice is hereby given that the City Council of the City of
Falcon Heights, Minnesota will meet in the City Hall in the City of Falcon
Heights, Minnesota at 8:00 P.M. on the 28th of December, 1983, to consider
the proposal of Bullseye Golf Center, Inc., that the City assist in financing
a project hereinafter described by the issuance of commercial development
revenue bonds.
Description of Project
Acquisition of land and the construction
thereon of 40,000 square feet of retail/
office space to be located at the northeast
corner of Snelling and Larpenteur to be
owned by Bullseye Golf Center, Inc.
The maximum aggregate estimated principal amount of the bonds
to be issued to finance this project is $2,000,000. The project will be
owned by Bullseye Golf Center, Inc.
The bonds if and when issued will not constitute a charge, lien
or encumbrance upon any property of the City except the project and such
bonds will not be a charge against the City's general credit or taxing powers
but will be payable from sums to be paid pursuant to a revenue agreement.
A draft copy of the proposed application to the Energy and Economic
Development Authority, State of Minnesota, for approval of the project,
together with all attachments and exhibits thereto, is available for public
inspection beginning December 7, 1983 from 8:30 o'clock
A.M. to 4:30 o`clock P.M., Monday through Friday, at the office of the Clerk
Administrator in Falcon Heights, Minnesota.
At the time and place fixed for the Public Hearing, the City Council
of the City of Falcon Heights will give all persons who appear at the hearing
an opportunity to express their views with respect to the proposal.
