RESOLUTION N0. 78-2?~ A RESOLUTION) APPROVING THE RE`LONING OF CERTAIN PROPERTY IN THE CITY OF FALCON HEIGHTS UPON THE APPLICATION OF HERMES FLORAL, INC., AND IMPOSING CONDITIONS ON ISSUANCE OF A BUIhDING PERMIT. RESOLVED, That the zoning map of the City of Falcon Heights, as set forth in Ordinance No. btu, as amended, shall be amended by rezoning the following described parcel. of property, portions of which are currently zoned T'R-1" -One Family Residential District, "R-2" -One and Two Family Residential District, and "R-3T"- Multiple Family Residential District, to "B-Z-A" -Limited Business and Processing District: The South 765 feet of the parcel of land which consists of the West 20 acres of the East ~ of the ,Southwest ~ and the East l5 acres of the West 2 of the .Southwest 4, all in Section 16, Township 29, Range 23; except the East 131 feet of the South 186 feet of said ~dest 20 acres and except the L~~est 60 feet of said East 15 acres. Subject to t,~ie rights of the public in County Road A (Larpenteur Avenue) and subject also to cartway easement upon the mast 33 feet thereof . tF,SOLVED, further, tY~xat an Ordinance amending the Zoning Ordinance be adopted to reflect paragraph one of this Resolution; tESOLVED, further, that the following conditions are imposed on the approval of the site plan and issuance of the building permit: 1. There shall be a permanent setback on the East side of the property in. the amount of 70 feet; 2. There shall be installed a berm and a fence on the East side of the property separating this ,parcel' from the single familaT homes to the East. The height and length of the berm and fence are to be negotiated and agreed upon between the property owners and the applicant for the building permit, Hewlett-Packard Compat~y; 3. There shall be a permanent setback on the North side of the property in the amount of 100 feet; !~. The site shall be graded to drain Southerly to Larpenteur Avenue, starting approximately l0 feet North of the Northerly service drive; 5• Snow storage shall be confined to the areas that drain toward Larpenteur Avenue to minimize the amount of snow melt that eventually may reach the undrained area PZorth of Lindig Street. 6. The roof system on the proposed building shall incorporate storage of rain water to delay runoff and to reduce the rates of flow along I,arpenteur Avenue. The system should be designed based on a 100 year storm of 6 inches in 2!~ hours. This Resolution is based on the timely notice given to surrounding property owners and the public concerning the rezoning petition, the testimony of interested persons at the hearing before the Planning Commission on December 11, 1978, and the testimony of interested persons at the hearing before the City Council on December 13, 1878.
