Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Falcon Heights, I~Linnesota, was held on the 10th day of
January, 1979.
The following members were present: Mayor Warkentien, Councilmembers Black,
McGough, Steele and Brown and the following were absent: None.
Councilmember Steele introduced the following resolution and moved its
adoption.
RESOLUTION 79-6
A RESOLUTION REQUESTING ENGINEEkING AND TECHNICAL ASSISTANCE
(ETA) FROM THE STATE OF MINNESOTA AND AUTHORIZING THE SIGNING
OF THE AGREEMENT.
BE IT RESOLVED, that pursuant to statutory authority, the Falcon Heights
City Engineer, for and on behalf of the alunicipality of Falcon Heights, is hereby
authorized to request and obtain from the N~.innesota Department of Highways, needed
engineering and technical services during the year of 1979; for which payment will
be made by the City of Falcon Heights upon receipt of verified claims from the
Commissioner of Highways.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Brown and upon a vote being taken the following voted in favor
thereof: I~iayor ~~arkentien, Councilmembers Black, McGough, Steele and Brown,
and the following voted against the same: None.
WHEREUPON, the motion was declared duly passed and adopted.

STATE OF MINNESOTA
DEPARTMENT OF TRANSPORTATION
TECHNICAL AND ENGINEERING ASSISTANCE AGREEMENT
THIS AGREEMENT, made and entered into by and between the State of
Minnesota acting through its Commissioner of Transportation, hereinafter re-
ferred to as the "State", and the County or City of Falcon Heights
hereinafter referred to as the "User", WITNESSETH:
WHEREAS, the User, as evidenced by Resolution, a copy of which is at-
tached hereto and made a part hereof as Exhibit A, does hereby request the
State to furnish from time to time as needed and specifically requested, tech-
nical and engineering assistance pursuant to M.S. 161.39: and
WHEREAS, The State is authorized to provide technical and engineering
assistance to other road authorities by M.S. 161.39.
• NOW, THEREFORE, it is mutually agreed by the parties hereto that:
1. The State may, upon written request by the User, provide technical
and engineering assistance and such other services as authorized by M.S. 161.39.
2. The State shall keep a record of its costs and expenses, including
overhead costs, in providing assistance and services to the User pursuant to
Paragraph 1 above, and shall prepare an itemized statement thereof showing the
amountt due hereunder and submit the same to the User on a~periodic basis.
3. The User agrees to pay to the Trunk Highway Fund of the State of
Minnesota all monies due hereunder and as shown by the invoices or statements
submitted to the User, within 30 days after such submission.
4. This Agreement is subject to cancellation by any party upon 60
days written notice.
IN WITNESS WHEREOF, the State and the User have caused these presents

R E S O L U T I O N
BE IT RESOLVED, That pursuant to Section 161.39, Subdivision 1 through 6, Minn-
esota Statutes, 1978, the municipal (County) (Municipal) Engineer
for and on behalf of the (County) (Municipality) of Falcon Heights
is hereby authorized to request and obtain from the Minnesota Department of Trans-
portion, needed engineering and technical services for which payment will be made
by the (County) (Municipality) upon receipt of verified claims from the Commissioner
of Transportation. This authority is to remain effective until recinded by either
party.
