CITY OF FALCON HEIGHTS
Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Falcon Heights, Minnesota, was held on
the 10th day of June, 1976.
The following members were present: Mayor Warkentien, Council-
men Ecklund, Steele, and Labalestra, and the following was absent: Council-
man Black.
Councilman Steele introduced the following resolution and moved
its adoption:

A RESOLUTION APPROVING AN AGREEP~NT TO PARTICIPATE IN
• THE MINNESOTA HIGHWAY SAFETY PROGRAM FOR ROADWAY SIGNING
IN FALCON HEIGHTS AS SUBMITTED BY THE CITY ENGINEER
(See attached Resolution)
The motion for tdle adoption of the foregoing resolution was duly
seconded by Councilman Labalestra, and upon a vote being taken, the follow-
ing voted in favor thereof: Mayor Warkentien, Councilmen Ecklund, Steele,
and Labalestra, and the following voted against the same: None.
WHENEUPON, the resolution was declared duly passed and adopted.

PROJECT FOR CORRECTING REGULATORY AND ti;TARNING SIGN DEFICIENCIES
APPLICATION FOR PARTICIPATION
It is our intent to proceed with a project to correct regulatory and
warning sign deficiencies on streets and roads under the jurisdiction

PROJECT FOR CORRECTING REGULATORY AND WARNING SIGN
DEFICIENCIES IN ROADWAY SIGNING
CITY OF FALCON HEIGHTS
AGREEMENT TO PARTICIPATE
TrJHEREAS, under the Federal Highway Safety Act of 1966, one of the
objectives set forth by the Department of Transportation is the conformance
of all traffic control devices to the National Manual on Uniform Traffic
Control Devices for Streets and Highways (MUTCD); and
WHEREAS, funds are available through the Federal Highway Administration
for the replacement of non-standard devices: and
TnIF[FA~;AS, the City of Falcon Heights is desirous of bringing the traffic
control devices on streets and roads under its jurisdiction into conformance
with National Standards;
NOW, TI3FR.EF'ORE,
• (1) It is hereby agreed that the City of Falcon Heights
wi11 comply with the conditions set forth in the
project description and wi11 remove, replace, or
install all regulatory and warning signs necessary
to comply with National Standards (MUTCD) as deter-
mined through an inventory of inplace signs and a
survey of needed additional signs. Such removal,
replacement or installation to be done by the City
of Falcon Heights on all streets and roads under its
jurisdiction and completed by January 1, 1977.
(2) The State of Minnesota, Departu~nent of Highways, wi11
review the work done and certify to the Federal High-
way Administration satisfactory completion for reim-
bursement from available Federal Highway Safety Funds
for 90~ of the actual project cost of such work in
accordance with conditions set forth in the Project
Description and the estimate of costs. Ten percent
(10~) of the project costs sha11 be paid by the City
of Falcon Heights. Reimbursement is applicable only
to the work done on the non-Federal Aid portion of the
street and road system by January 1, 1977. The
amounts for reimbursement of materials sha11 be limited
to costs of standard materials commonly used by the
Minnesota Highway Department.

(3) The City of Falcon Heights agrees to maintain all such
sign installations in satisfactory condition.
(~.) Appendix ~~A~~covering Federal Department of Transportation
Regulations on Non-discrimination and attached to this
Agreement is an integral part of the Agreement and is to
be complied with by the City of Falcon Heights. Minnesota
Statutes 181.59 are herein incorporated in this Agreement
by reference.

APPENDIX A
•
NON-DISCRIMINATION CLAUSES
During the performance of this Agreement, the City of Falcon Heights,
for itself, its assignees in interest (hereinafter referred to as the
"Municipality"), agree as follows:
(1) Compliance with Regulations: The Municipality will comply with the
regulations of the Department of Transportation relative to nondis-
crimination in f ederally-assisted programs of the Department of Trans-
portation (Title 1~9, Code of Federal Regulations, Part 21, hereinafter
referred to as the Regulations), which are herein incorporated by re-
ference and made apart of this Agreement.
(2) Nondiscrimination: The Municipality, with regard to work performed
by it after award and prior to completion of the force account work,
will not discriminate on the ground of race, color, or national origin
including procurements of materials and leases of equipment. The
Municipality will not participate either directly or indirectly in the
discrimination prohibited by Section 21.5 of the Regulations.
(3) Solicitations for Procurements of Materials and Equipment: In all
solicitations either by competitive bidding or negotiation made by the
Municipality for procurements of materials or equipment, each potential
supplier shall be notified by the 14iunicipality of the Piunicipality's
• obligations under this Agreement and the Regulations relative to non-
discrimination on the ground of race, color or national origin.
(!~) Information and Reports: The Municipality will provide all informa-
tion and reports required by the Regulations, or orders and instruc-
tions issued pursuant thereto, and will permit access to its books,
records, accounts, other sources of information, and its facilities
as may be determined by the State Highway Department or the Federal
Highway Administration to be pertinent to ascertain compliance with
such Regulations, orders and instructions. Where any information re-
quired of a Municipality is in the exclusive possession of another who
fails or refuses to furnish this information, the Municipality shall
so certify to the State Highway Department, or the Federal Highway
Administration as appropriate; and shall set forth what efforts it has
made to obtain the information.
(5) Sanctions for Non-compliance: In the event of the Municipality non-
compliance with the non-discrimination provisions of this Agreement,
the State Highway Department shall impose such Agreement sanctions
as it or the Federal Highway Administration may determine to be appro-
priate, including, but not limited to:
(a) Withholding of payments to the Municipality under the Agreement
until the Municipality complies, and/or
• (b) Cancellation, termination, or suspension of the Agreement, in
whole or in part.
