RESOLUTION 76- 27
A Resolution Pertaining to the Preliminary
Approval of the Survey, Subdivision and
Variance for Lot Subdivision for Glenn O.
Martin
WHEREAS, the City of Falcon Heights by Resolution No.
75-4, dated January 9, 1975, designated an area north of
Larpentuer Avenue, east of Lindig Street, and west of
Fairview Avenue as a "no-build area" due to the lack of
storm sewer drainage facility provisions and likely damage
to existing homes and municipal facilities from the altera-
• tion of surface drainage of water should additional homes be
constructed in the "no build area"; and
WHEREAS, the City of Falcon Heights by Resolution No.
76-8 considered the preliminary subdivision plans of Mr.
Glenn O. Martin (subdivider) to acquire the west one-half of
a lot described in said resolution a portion of which lot is
within the "no-build area"; and
WHEREAS, certain of the conditions contained in Resolu-
tion No. 76-8 have not as yet been met by subdivider and cer-
tain other information has been requested by the City Engineer
and the City Attorney principally the following:
1. The elevation of the proposed home when constructed.
2. The contour elevations of the land when the pro-
• posed home is constructed.
3. Approval by the City Engineer indicating that the
drainage. will not be affected by the construction
of the house.
WHEREAS, the City Council finds that there are particu-
lar facts and circumstances that exist in this application
and that an extraordinary hardship may result if strict com-
pliance of the subdivision and platting regulations are re-
quired because of:
1. The short building season.
2. Mr. Martin is employed as a school teacher and
is now free to devote his full time to the con-
struction of the house.
3. The asthmatic condition of his children which
requires an airconditioned home.
4. The proposed subdivision is similar to a series
of subdivisions previously approved by the Plan-
• ning Commission and the Council.
NOW, THEREFORE, IT IS HEREBY RESOLVED as follows:
1. The City Council gives its preliminary approval to
the survey of Charles O. Georgi of the proposed subdivision.
2. The preliminary survey is referred to the Planning
Commission for review and comment at their meeting scheduled
for June 14, 1976,
3. The strict compliance with the subdivision ordinance
is hereby waived including the time periods expressed therein.
4. The subdivider is required to provide the information
contained in the request of the City Attorney and the City
Engineer to the City Council and the City Engineer as soon as
possible.

5. The City Clerk-Administrator is authorized to cause
publication of the public hearing on said subdivision to be
made in the City's legal newspaper for hearing before the
City Council at 8:00 p.m. on June 24, 1976.
