Mayor Warkentien, Councilmen .Black, and the following were Councilman Steele introduced the following resolution and moved its adoption. RESOLUTION 76-39 A RESOLUTION REQUESTING ENGINEERING AND TECHNICAL ASSISTANCE (ETA) FROM THE STATE OF MINNESOTA AND AUTHORIZING THE SIGNING OF THE AGREEMENT. BE IT RESOLVED, that pursuant to statutory authority, the Falcon Heights City Engineer, for and on behalf of the Municipality of Falcon Heights, is hereby authorized to request and obtain from the Minnesota Department of Highways, needed engineering and technical services during the year of 1977; for which payment will be made by the City of Falcon Heights upon receipt of verified claims from the • Commissioner of Highways. The motion for the adoption of the foregoing Resolution was duly seconded by Councilman Ecklund and upon a vote being taken the followi ng voted in favor thereof: Mayor Warkentien, Councilmen Black, Ecklund Steele and Labalestra and the following voted against the same: None. W ENTIEN, Mayor Attest: Dewar B. r3arnes, Clerk-Administrator Special meeting of December 29, 1976. i~~_ MHD No. 30780 (11/7!0 t STATE OF N~NNESOTA DEPARTMENT OF HIGHWAYS TECHNICAL AND ENGINEERING ASSISTANCE AGREEMENT THIS AGREEMENT, made and entered into by and between the State of Minnesota acting through its Commissioner of Highways, hereinafter ref erred to as the "State", and the City of Falcon Heights, hereinaf ter ref erred to as the "User", WITNESSETH: WHiF~~,EAS, the User, as evidenced by Resolution, a copy of which is attached hereto and made a part hereof as Exhibit A, does hereby request the State to furnish from tune to time as needed and specifically requested, technical and engineering assistance pursuant to M.S. 161.39; and NOW, THEREFORE,, it is mutually agreed by the parties hereto that: 1. The State sha11, upon written request by the User, provide technical and engineering assistance and such other services as authorized • by M.S. 161.39. 2. The State shall keep a record of its costs and expenses, in- cluding overhead costs, in providing assistance and services to the User pursuant to Paragraph 1 above, and shall prepare an itemized statement thereof showing the amount due hereunder and submit the same to the User on a (monthly) (annual) basis. 3. The User agrees to pay to the Trunk Highway Fund of the State of Minnesota all monies due hereunder and as shown by the invoices or state- menu submitted to the User, within 30 days after such submission.
