HomeMy WebLinkAboutCCRes_72-06a^ RESOLUTION 2-6 RESOLUTION GRANTING A VARIANCE FROM PROCEDURES RDaUIRED IN SUBDIVIDION ORDINANCE N0. 69 WHEREAS, A. A building permit was issued to Mr. Leo F. Pothers on November 22, 1971, on behalf of the Village for the purpose of constructing a house at 18113 North Hamline Avenue. B. At the time said building permit was issued the property on which said house was to be located had been subdivided by metes and bounds into a lot. C. Said subdivision was not approved by the Village Council in accordance with Ordinance Noy 69. D. Since the issuance of said building permit, a house has been constructed on said lot pursuant thereto. E. For purposes of recording of the lot with the Register of Deeds and other county officials it is necessary that said subdivision be formally approved by the Village Council. F. An extraordinary hardship would result to the owner of said lot if he were required at this time to comply with all of the procedures set forth in Ordinance No. 69 for purposes of obtaining Village Council approval of said subdivision, and no practical purpose would be served at this time in requiring compliance with said procedures. NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the Village of Falcon Heights, that Mr. Leo F. Pothers is hereby granted a variance from the procedures set forth in Ordinance No. 69 for purposes of obtaining approval of said subdivision so that he may submit to the Village Council at this time for final approval of said subdivision.
