HomeMy WebLinkAboutCCRes_72-16 • EXTRACT' OF MINU`1'ES OF MEETING OF THE VILLAGE COUNCIL Oh' THE VILLAGE OF FALCON HEIGHTS, MINNESOTA HELD: JUNE 22, 1972 Pursuant to due'call and notice thereof, a regular meeting of the Village Council of the Village of Falcon Heights, Minnesota, was duly called and held at the .Village Hall in said Village on the 22nd day of June, 1972, at 8:00 o'clock P.M. The following members were present : .,Mayor Warkentien, Councilmen Black, Ecklund, Stone, Taylor, and the following were absent : None Member Councilman Ecklund introduced the following resolution and moved its adoption: RESOLUTION 72-1 RESOLU'1~IbN~'1~~. G PRELIMINARY REPORT AND CALLING PUBLIC HEARING ON STREET IMPROVEMENTS OF 1972 • WHEREAS: A. The Village Council deems it necessary and expedient that the Village of Falcon Heights, Minnesota, construct certain improvements, to-wit: construction of bituminous curbing, including sod replacement, in the Village, as described in and in accordance with the preliminary plans and report prepared by Bonestroo and Associates, consulting engineers; B. The Council has been advised by the consult- ing engineers that said Street Improvements of 1972 are feasible and should best be made as proposed, and the consulting engineers' report to this effect has hereto- fore been received by the Council, and filed with the Village Clerk; C. The statute provides that no such improvements shall be made until the Council shall have held a public hearing on such improvements following mailed notice and two publications ttlereof in the official newspaper stating time and place of the hearing, the general nature of the improve- ment, the estimated costs thereof, and the area proposed to be assessed, in accordance with law; • NOW T}IEREFORE, ~3E IT RESOLVED by the Village • Council of the Village of Falcon Heights, Minnesota, as follows 1. A public hearing will be held at the time and place set forth in the Notice of Hearing hereto attached to consider said proposed improvements. 2. The nature of the improvements, the estimated cost thereof, and the area proposed to be assessed therefor are described in the form of Notice of Hearing hereto attached. 3. The notice of said public hearing shall be in substantially the form contained in the notice hereto attached. 4. The Village Clerk is hereby authorized and directed to cause notice of said hearing to be given two publications in the official newspaper. Said publications shall be one week apart, and at least three days shall elapse between the last publication and the hearing. Not less than ten days before the hearing the Clerk shall mail notice of the hearing to the owner of each parcel of land within the area proposed to be assessed as described in the notice. For the purpose of giving such mailed notice, owners shall be those shown to be such on the records of the County Auditor or, if the tax statements in the County • are mailed by the County Treasurer, on the records of the County Treasurer. As to properties not listed on the records of the County Auditor or the County Treasurer, the Clerk shall ascertain such ownership by any practicable means and give mailed notice to such owners. The motion for the adoption of the foregoing resolution was duly seconded by member Councilman Black and upon a vote being taken thereon, the following voted in favor thereof: Mayor Warkentien, Councilmen Black, Ecklund, Stone, Taylor, and the following voted against the same: None Whereupon said resolution was declared duly passed and adopted. -2- . ~ - • NOTICE OF PUBLIC HEARING ON IMPROVEMENTS TO WHOM IT MAY CONCERN: • TIME AND PLACE: Notice is hereby given that the Village Council of the Village of Falcon Heights, Minnesota, will meet at the Village Hall in said Village on Thursday, July 13, 1972, at 8:00 o'clock P.M.,,to consider the construction of the following improvements, to-wit: NATURE OF IMPROVEMENT: The construction of bituminous curbing, including sod replace- ment, along the eastern side of Fry Street between Larpenteur Avenue to a point approximately 175 feet north thereof which is the northwestern point of the B-2 zoning district abutting Fry Street, and along the western side of Fry Street between Lar- penteur Avenue and a point approx- imately 450 feet north thereof which is the northeastern point of the R-3 zoning district abut- ting Fry Street, in the Village of Falcon Heights. ESTIMATED COST: The total estimated cost of said improvements is $ 1000.00 . AREA PROPOSED TO BE ASSESSED: The area proposed to be assessed for such improvements is every lot, piece or parcel of land within the Village of Falcon Heights, Minnesota benefitted by said improvements abutting thereon based on benefits received and without regard to cash valuation. AUTHORITY: The Council proposes to proceed under the authority granted by Chapter 429 M.S.A. r~ U n U . .
