. VILLAGE COUNCIL OF THE VILLAGE OF
FALCON HEIGHTS, MINNESOTA
HELD: November 20, 1972
Resolution No. 72-53
Pursuant to due call and notice thereof, a regular
meeting of the Village Council of the Village of Falcon Heights,
Minnesota, was duly held at the Village Hall in said Village on
the 20th day of November, 1972, at 7:30 o'clock P.M.
The following members were present: Mayor Warkentien,
Councilman Black, Councilman Stone, Councilman Eckland, Council-
woman Stocker and the following were absent: none.
Member Stocker introduced the following resolution
and moved its adoption:

RESOLUTION CONCERNING THE USE OF THE LINDIG PROPERTY

WHEREAS, Mr. Arthur Lindig has been a resident
of this area for many years, including a period
prior to the incorporation of the Village of
Falcon Heights;
WHEREAS, Mr. Lindig resides at 1875 West
Larpenteur Avenue, and adjoining his residence
is a lot, also owned by him, upon which is
located a greenhouse;
WHEREAS, Mr. Lindig is desirous of selling
one lot and improvement thereon, but is having
difficulty because the immediate area is zoned
"R-3" pursuant to ordinance No. 6~+ of the
Village of Falcon Heights;
WHEREAS: Mr. Lindig's greenhouse was built
prior to the adoption of Ordinance No. 64 and
is considered a previously existing noncon-
forming use in the "R-3"distr.ict;
WHEREAS, Section ~+.3 (5) of Ordinance No. 6~+
provides, in essence, that if a lawful non-
conforming use is destroyed by fire, explosion
~, or some act of God, it may not be reconstructed
if the structure is destroyed to an extent
greater than 50/ of its value;
WHEREAS, the proposed purchaser of the Lindig
greenhouse desires an assurance that if any of
the conditions set forth in Section ~+,3 (5) of
Ordinance 6~+ occur at some time in the future,
the Village Council will allow the structure
to be rebuilt, thus re-establishing a non-
conforming use in the "R-3" district,
NOW THEREFORE, it is hereby resolved by the
Village Council of Falcon Heights as follows:
1, In the event that at some future
time, any of the conditions set
forth in Section 4,3 (5) of the
Ordinance 6~+ occur to what is now
the Lindig greenhouse, the Village
Council of Falcon Heights now gives
every reasonable assurance that favor-
able consideration will be given to
the buyer of said property in his
application for a conditional use
permit, so that the business may
be continued to the same extent as
prior to the destruction of the
premises,
The motion for adoption of the foregoing resolution
was duly seconded by Member Black and upon a vote being taken
thereon, the following voted in favor thereof: Mayor Warkentien,
Councilman Black, Councilman Eckland, Councilwoman Stocker,
The following voted against the same: Councilman
Stone.
Whereupon said resolution was declared duly passed
and adopted.
