HomeMy WebLinkAboutCCRes_02-21• No. 02-21 City of Falcon Heights City Council Resolution Date: December 18, 2002 Resolution APPROVING a Variance for 2190 Folwell Avenue On December 18, 2002, the Falcon Heights City Council approved the following variance request for 2190 Folwell Avenue, legally known as Lot 1 and the north 46 feet of Lot 2, except the east 40 feet of both lots, Auditors Subdivision No. 71: Chapter 9-4.01, subdivision 4 (c) of the zoning code, in an R-1 zoning district: A variance of 15 feet, to allow the construction of an addition to the south side of the existing home, where a minimum of 30 feet is required in the zoning code. The City Council adopted the following findings for granting the variance at 2190 Folwell Avenue: a. That the granting of the variance will not be detrimental to the public welfare; • b. That the granting of the variance will not substantially diminish or impair property values or improvements in the area; c. That the granting of the variance is necessary for the preservation and enjoyment of substantial property rights; d. That the variance will not impair an adequate supply of light and air to adjacent property. e. That the variance will not impair the orderly use of the public streets; £ That the variance will not increase the danger of fire or endanger the public safety; g. That a particular hardship, as distinguished from mere inconvenience to the owner, would result if the strict letter of the chapter were carried out. h. That the variance is not sought principally to increase financial gain of the owner of the property, but that a substantial hardship to the owner would result from a denial of the variance.
