HomeMy WebLinkAboutBy*LawsJ r ROUGH DRAFT: ,~ CITY PLANNING COMMISSION BY'~LAWS ARTICLE I - DUTIES AND OBJECTIVES 1.1 The Commission is designed to serve in an dvisory capacity to the City Council and Adnnistration~anc~~carry out the duties as perscribed by Ordinance #64 1.2 The objectives of the commission are to guide future develop- ment of land, services, and facilities so as to ensure safe, pleasant and economical environment-for residential, commercial, industrial and public activities and so as to promote the public health, safety, morals and general welfare. In order to bring about the achievement of these objectives the commission shall: a. establish community objectives and policy, b. make recommendations to the City Council regarding petitions and applications for rezoning, special use permits, etc. c. review all matters relating or affecting the physical developmentiof the City, d, draft and recommend to the City Council for adoption regulations and ordinances authorizing and empowering the enforcement of its findings relating to the physical development of the City, and e. serve as a forum for citizen involvement. ARTICLE IT - MEMBERSHIP 2.1 Number. Said commission shall consist of not more than nine nor less than seven citizen members who are eligible voters residing within the City limits of Falcon. Heights appointed by the Mayor and approved by the City Council. 2.2 Terms. Members shall be appointed for terms of two years. Any vacancy in the membership shall be filled by appointment by the Mayor subject to confirmation by the City Council and such vacancy appointments shall be for the unexpired term of the vacating member. No member may serve more than five consecutive terms. 2.3 Removal.Members shall be subject to removal for cause only after Council approval. 2.4 Absenteeism. Any member who fails to attend three consecutive regular meetings of the commission without satisfactory explaina- tion shall be subject to removal as a member of said commission. 2.5 Misc. Members shall serve without salary but will be reimbursed for any out of pocket expense to attend .meetings or make out of town trips, as authorized by the Council. .. ARTICLE III - OFFICERS AND DUTIES 3.1 Titles. The officers of this commission shall be a Chairperson, Asst. Chairperson and a Secretary. • 3.2 Duties of the Chairperson. The Chairperson shall preside at all meetings and exercise the same voting rights as the other members and carry out such duties as are assigned by the commission. 3.3 Duties of the Vice Chairperson. The Vice Chairperson shall act in the absence or inability of the Chairperson to act in such. instances and shall have the powers and functions of the Chairperson. 3.4 Duties of the Secretary.Th.e Secretary shall be responsible for recording transactions and actions of the commission and carrying out such other duties as are assigned by the Commission Chairperson. ARTICLE IV - ELECTION OF OFFICERS 4.1 Terms. Officers shall be elected at the annual meeting each year. Terms of office shall be for one year and no member shall hold the office of Chairperson or Vice Chairperson for more than two years consecutively. Officers shall serve until replaced by a duly elected 'officer in accordance with these proceedures. 4.2 Nominations. Nominations shall be made from the floor. 4.3 Majority required. The officer receiving the majority vote of the commission membership shall be duly elected. • 4.4 Date of Office. Newly elected officers shall take office immediately upon selection. 4.5 Vacancies occuring in offices of the Commission shall be filled forthwith by regular election proceedure. ARTICLE V - MEETINGS 5.1 Annual Meetings. An annual orgaizational meeting shall be held at the regular February meeting each year. Election of officers shall be conducted and proposed ammendments ty by-laws be acted upon. 5.2 Regular Meetings. Regular meetings of the commission shall be held monthly as scheduled. A special meeting may be called by the City Council or the Chairperson. 5.3 Notice of Meetings. Notice in writing, of each meeting shall be sent to all commission members at least 5 days before said meeting and shall state the time and purpose of the meeting. 5.4 Agenda. The agenda for each meeting of the commission shall be submitted to the commission members with the notice of meeting. 5.5 Application Deadlines. No matter shall be placed on the agenda • unless written request or petition, along with the necessary forms, legal forms, legal description, maps, drawings, etc., have been submitted in proper and correct form. 5.6 Reports. Report of the previous meeing shall be sent-to commission members along with the meeting notice. . ~ ~, ARTICLE VI - MEETING PROCEEDURE 6.1 Rules of Order. Unless otherwi.s_e specf.call.y designated, Roberts Rules of Order shall govern meeting proceedure. However, deliberative sessions of the commission shall be conducted as informally as possible,= 6.2 Quorum. A majgrity of the membership of the commission shall constitute a quorum for meeting purposes. 6.3 Appearance of the Petitioner. No application or petition shall be given final approval unless the applicant or petitioner appears personally or is represented at the meeting pr makes. a satisfactory explaination or presentation n.lieu thereof. 6.4 Disposition. A motion must be made and voted upon in order to dispense with an item on the agenda. No binding or final action shall be taken on any matter on the. :agenda except at an annual, regular or special meeting. 6.5 Tabling. A tabling motion if passed has the effect of laying over until the next meeting unless otherwise specified. ARTICLE VII - EFFECTIVE DATE 7.1 .These by--laws shall take effect on November 22, 1977. RELATIONSHIPS: Reports on a line basis to: Chairperson - Planning Commission, and the commission as a body to the city council through the council liaison SPECIFIC RESPONSIBILITIL'S: In order to achieve the objective, the commission shall: 1. Through the city council liaison, establish community objectives and policy. 2. Through the city council liaison, make recommendations and applications to the city council for rezoning, special use permits, etc. 3. Through the city council liaison, draft and recommend to the city council for adoption regulations and. ordinances authorizing and empowering the enforcement of its findings relating to the physical development of the city. 4. To review ail matters relating or affecting the physical development of the city. 5. To serve as a forum for citizen involvement. 6. To attend regular monthly meetings of the commission, as well as special meetings called by the city council or the chairperson; failure to attend three consecutive regular meetings of the commission without satisfactory explanation shall make member subject to removal of the commission. 7. To serve without salary, but to be reimbursed for any out of pocket expense for out of town meetings or special trips, if any, as authorized by the city council. $.
