HomeMy WebLinkAboutPCMin_80Jul7MINUTES PLANNING COMMISSION MEETING JULY 7, 1980 • The Meeting was called to order at 7:30 p.m. by Al Stefanson in the absence of Chairman Les Larsen. Commission Members present were Jerry Wallin, Harold Nilsen, Elving Anderson, Erma Olson, Al Stefanson, Bob Blomberg, and Jim Bourquin. Present for the City Council was Helen Brown. The first item of business was consideration of a variance request submitted by Karen and Henry Panowitsch. They submitted a permission letter from Maureen and Richard Willard, their neighbors to the south. The Commission reviewed Ordinance No. 64, specifically .Section 7.4. Harold Nilsen was of the opinion that the Panowitsch residence was a one story residence within the meaning of Section 7.4. As the mayor at the time Ordinance No. 64 was adopted, Harold Nilsen stated the Panowitsch residence was not intended to fall within the two story classification as contemplated by the Ordinance. Nilsen moved that. the matter be referred to the City Council with the Planning Commission's recommendation that Mr. and Mrs. Panowiisch receive a refund of :their $10.00 variance application fee, the Planning Commission being of the opinion that no variance was required by Section 7.4 of the Zoning Ordinance upon the proviso that the .garage extension to be constructed on the Panowitsch property remain at least 5 feet or more from the south property line. Jerry Wallin seconded the motion. Those in favor were Nilsen, Anderson, Wallin and Stefanson. Those opposed were Blomberg and Olson. The motion was carried. Item No. 2 on the agenda was the consideration of a conditional use permit . application by Thomas W. Barron, .1905 Arona Ave., for the purpose of constructing a swimming pool in their back yard. Upon consideration of the submitted plans and a review of the Zoning Ordinance No. 64 and the Swimming Pool Ordinance 465 the Planning Commission was of the opinion that Section 6.3 of the Zoning Ordinance provided that a swimming pool in an R-1 zoned property is a permitted use not re- quiring a conditional use permit. Ordinance No. 65, in the opinion of the Planning Commission, requires only an adherence to the applicable plumbing code and not a conditional use permit. Nilsen again moved that the matter be referred to the City Council with a recommendation that-.the swimming pool permit required under Ordinance N0. 65 be issued and the the $10.00 conditional use permit application fee be refunded upon the following grounds: 1. The Zoning Ordinance does not consider a swimming pool on R-1 zoned property to be a conditional use; 2. Ordinance No. 65 does not establish a requirement for a conditional use permit. Comprehensive Planner Carl Dale appeared and advised the Commission as follows: a. Metro Council has granted the City's application for a six month extension to allow surrounding communities and the Council to review the Comprehensive Plan. b. Updated and revised Comprehensive Plan texts were distributed and the old copies were returned. The map series to go with the text is not yet quite complete but will be available by the July 23, 1980 Public Hearing. c. Carl conducted a slide show depicting traffic and aesthetic problems existing within the business district. It was informally agreed among the Planning Commission .that Mr. Dale should present a similar slide show at the Public Hearing scheduled for 7:00 p.m, on July 23. Carl suggested that the City Council and the Planning Commission jointly hold the Public Hearing scheduled for July 23, 1980 for the purpose of presenting the Comprehensive Plan to the community residents. He makes this suggestion even though the law provides that the Council cannot vote on any resolution to adopt the Plan that arises out of the Public Hearing. The only voting members on the reso- lution to recommend adoption of the Comprehensive Plan for referral to the City Council are the Planning Commission Members. e. The text of the Comprehensive Plan has been distributed to surrounding communities and is currently undergoing review by them. Jim Bourquin moved that the Commission adopt a resolution commending Carl Dale for his efforts to date recognizing the limited amount of time in which he has acted in the City's behalf and adopting the updated and revised text of the Compre- hensive Plan for presentation to community residents at the Public Hearing scheduled for July 23-with one recommended change, that being that the property currently re- flected as being zoned "historic" on the northwest corner of the intersection. of Cleveland and Larpenteur on City Plan Map, Part 1, be redesignated as single family until such time as it may be sold for public or historic purposes. The motion was seconded by Elving Anderson. The resolution was unanimously passed.
