PLANNING COMMISSION MEETING
NOVEMBER 2, 1981
• The meeting was called to order at 7:00 p.m. by Chairman Stefanson. Also
present were Olson, Bourquin, Mead, Nilsen, Wallin, Blomberg, Labalestra,
Waldo, and Council Liaison Sandy Larson. Also in attendance were Mayor
Warkentien, Councilmembers Steele, Brown and Eggert, City Planner Carl
Dale, City Engineer Brad Lemberg and City Attorney David Allen.
The first item of business was the variance request of Robert Butala, 1530
W. Iowa, to permit construction of a driveway 22 feet from his east property
line. Butala distributed a prepared statement and a listing of several points
in support of his application. Among the points in support were the following:
1. There is existing precedent within the City for permitting the request.
2. The proposed use is consistent with R-1 permitted uses.
3. Denial would place a hardship on the growing Butala family.
4. The proposed use is a practical and realistic approach to the
current economic and housing conditions.
5. Three out of four adjacent property owners are not in opposition.
Mrs. Leah Johnson, 1524 W. Iowa, spoke in opposition to the requested variance.
She was concerned that a reduction of her property value would result. Her
opposition-was,. in all respects, emphatic, and she stated several times that
she did not want such a driveway next to her property. There was a motion by
Olson-that the application for a variance, as regeusted, be recommended to the
City Council for approval. A second was offered by Labalestra, whereupon a
roll call vote was taken. Those in favor .were Olson, Mead, Labalestra, Waldo
. and Wallin. Opposed were Bourquin, Nilsen, Stefanson and Blomberg. The motion
carried by a vote of 5 to 4.
The next item of business was the rezoning request of American Shelter Corpo-
ration. This request sought to rezone the property immediately to the north
and west of Hewlett-Packard to a combination of B1A and R3. In support of
this request larger scale drawings were presented showing residential con-
struction consisting of townhouses and condominiums. Also included in the
plan was a surface water containment plan calculated on the basis of a 1G0
year storm. The proposed densities were 7.61 townhouse units per acre and
13.9 condominium units per acre with an average density of 10.18. Carl
Dale commented generally as follows:
1. The B1A portion is consistent with the Comprehensive Plan.
2. R3 zoning would allow for up to 20 units per acre.
3. Still thinks PUD zoning would be in everybody's best interests.
Carl also commented by letter generally along the lines that anything less
restrictive than PUD would not afford the City adequate control over this
proposed project.
Brad Lemberg confirmed that the 100 year storm calculation checked out and
stated that the street plan was better.
In the midst of the discussion of American Shelter's rezoning .request,
• Nilsen proposed a resolution to study surface water run. off in the proposed
building site and surrounding environs. Lemberg said the study had been
done in 1974. Nevertheless the resolution was unanimously carried and the
City Council is requested to consider acting in accordance with the reso-
lution.

• Many residents of the community were in attendance and generally expressed
mild to extreme displeasure at the thought of any increased traffic on Tatum,
Prior, Summer and Autumn Streets. Upon motion by Bourquin, seconded by Olson,
the request that the northerly portion of the property in question be rezoned
R3 was unanimously NOT recommended for approval. Upon motion by Labalestra,
seconded by Waldo, the request that the remaining portion of the property be
zoned BiA was unanimously NOT recommended for approval.
There being no further business, the meeting was adjourned.
