Black, Grittner, Nestingen, Northrop, Boche, Finegan, Mead and Daykin. Duncan. Boche moved, seconded by Finegan, to approve the August 4, 1986 Planning Commission Minutes as presented. Motion carried unanimously. Patricia Zappa, 1853 Simpson, requested a variance to construct a driveway to come within one (1) foot of the property line. Mr. Zappa explained that the extra driveway width is needed for parking three cars. He presented a letter from his neighbor at 1847 Simpson, Carol J. Slavick, expressing no objection and advised that snow removal had been discussed. Finegan moved, seconded by r4ead, to approve the variance request to Mr. and Mrs. Zappa to construct a driveway to within one foot of the property line. Motion carried unanimously. CALL TO ORDER PRESENT ABSENT 8/4/86 MINUTES APPROVED VARIANCE REQUEST FOR PATRICIA ZAPPA, 1853 SIMPSON, APPROVED Irene M. MacGregor, 1795 North Fairview, presented a subdivision request to sell 202 feet to create a new lot--such lot to be purchased by David and SUBDIVISION Virginia Price who plan to build a single family dwelling. Ms. MacGregor REQUEST FROM is planning for the allowance of 55 feet for the construction of a cul-de-sac MRS. IRENE leaving the lot size to be 147 feet by 96.38 feet or 14,147.86 feet. She MAC GREGOR advised that the lot had been previously located in a "no-build" zone but due AND SPING to storm sewer extensions the land had been taken out of that area. Discussions AND YING- concerning the issue were held with the City Engineer and City Staff. In order NGOH LIN to make the lot buildable the lot will have to be filled and the drainage issue APPROVED addressed. Discussion ensued regarding the one foot easement and who was the owner of that easement. City Staff and Mrs. MacGregor are in the process of resolving the issue. Grittner questioned who would be building the street and paying for it to which Mrs. MacGregor advised that the City of Falcon Heights has pre-determined what the assessments would be and each property owner concerned would be assessed for the street extension. After further discussion, Grittner moved, seconded by Boche to approve the subdivision request as proposed by Irene M. MacGregor, 1795 North Fairview and another subdivision request as proposed by Sping and Ying-Ngoh T. Lin, 1785 North Fairview (neighbors to the south). Finegan proposed a friendly amendment as follows: (1) the Lin property subdivision will be in line with the boundary consistent with that of the MacGregor property, (2) improvements (street and utility) should be arranged through the city and assessed against the benefitted property owners, and (3) drainage should adequately be provided for. Grittner and Boche accepted the friendly amendment and upon a vote being taken, the following voted in favor thereof: Black, Grittner, Northrop, Boche, Finegan, Mead and Daykin and the following voted against the same: Nestingen. Motion carried. Rebecca Bierbaum, 1745 Simpson, requested a variance to construct a driveway to within two (2) feet of the lot line. Mr. Bierbaum presented a letter from his neighbor, Norm Sainty, 1755 Simpson, who voiced no objection. The present concrete driveway will be removed and replaced with asphalt. Mead moved, seconded by Finegan, to approve the variance as requested. Motion carried unanimously. G. Behrens requested a variance on property located on the Lindig extension, east of 1816 Tatum. He needs the variance to build a new home on the lot because a road easement may take part of the property leaving less than 10,000 square feet (which is required by City Code). After a discussion on the variance request due to the fact that no drawing was provided as to placement of the home on the lot, .lot size and where the easement would be located, the variance request was tabled to the next Planning Commission meeting. The Planning Commission requested that the above referred to information be furnished as well as information as to: (1) what provisions are being made for extending the street, (2) the overall plan for the development of the remaining Lindig property, and (3) has the storm drainage issue been thoroughly discussed. Also, information was requested on whether or not a subdivision request had already been approved. The issue should be placed on the next Planning Commission agenda. Boche moved, seconded by Grittner, to adjourn the meeting at 8:45 P.M. Motion carried unanimously. • Edgar negan, Secre ry G.
