HomeMy WebLinkAboutPlanning Commission_1976 MINUTES ~ ~ " PLANNING COMMISSION FALCON HEIGHTS, MINNESOTA REGULAR MEETING DECEMBER 13, 1976 A regular meeting of the Falcon Heights Planning Commission was called to order by Chairman Plant at 7:30 p.m. Chairman Plant, Members Stone, Larson, Blomberg, Schwantes, Ohman and Lammers. Also present was newly appointed member Michael Heffron. Member Yonan. Chairman Plant announced that he had submitted his resignation as a member of the Commission to the City Council to be effective December 31, 1976. He stated the work on the Commission was enjoyable and that he appreciated the cooperation and loyalty of the members. Michael Heffron was introduced as a new member to replace Plant on the Commission. A brief review was given of Idle workshop at Roseville City Hall on November 15, 1976, concerning the implementation of the Minnesota Land Planning Act in the metropolitan area. It was felt that a comprehensive plan should be developed for land use of our. city so that the Systems Statement that will be sent to Falcon Heights, after March 1, 1977, can be studied for possible con- flict. Member Schwantes, who was previously named as contact person for the Metropolitan Council on the Planning Act, will get in touch with that office to determine the date for receipt of Systems Statement and preparation necessary. Member Lammers agreed to contact the University of Minnesota Planning Department as to their plans for future use of land along Larpenteur Avenue. _ It was decided to hold an organizational meeting on Monday, January 3, 1977, at 7:30 p.m., with Member Ohman to be Acting Chairman for the meeting. This will confirm our telephone conference of August 16, You have inquired as to the procedures to be followed by the City of Falcon Heights in permitting a portion of the old Applebaum store to be used for a "dog obedience school." We have reviewed the applicable provisions of Ordinance No. 6t, as amended. The subject property is zoned B-2. Sec- tion 1.1 of Ordinance No. 6n~' defines '°permitted uses°' within B-2 retail business districts. Those uses which are "not per- mitted" uses but are conditional uses which require a condi- tional use permit are defined in Section 11.2. While a dog obedience school is not defined as a permitted use, Subd. Mr® Sederberq's propert~~ is :Located in an area that is zoned "R-1"o erection 6.2(5) provides that acces- sory structures other than private garages are permitted uses ~,~ithizl an R-1 district but a conditional use permit must be issued for such a conditional use. Under the definition of '°structures", I would construe a television or radio tower as being an accessory structure. Thus, the Council must look at the facts of each application and deter- mine whether a conditional use permit shall be issued. Another section of the R-1 regulations is also pertinent here. Section 6.4(1) provides that no building or structure shall exceed two stories or twenty-five feet in height, whichever is less, except as provided in Section .: 15 of the ordinance. A television or radio tower is an accessory use and the applicant a7~ust secure a conditional use permit from the Council for such accessory use in an R-1 district. ?. If the Council determines that the applicant is entitled to a conditional use permit, the tower may not exceed twenty-five feet in height. 3. There is no authority to increase the height limitations by fifty percent under Section 15 of the ordi- nance. 4. The Council could grant a variance and a • conditional used the conditional use for the basic struc- ture and the varia~~ce to allow the structure to exceed twenty-five feet in height. The normal variance rules would apply as set forth in Section 16 of the ordinance. In essence, the Council would have to determine whether there is some definite hardship or difficulty imposed on the applicant and that the request is not simply for the convenience of the applicant. I should note that television and radio stations and transmitting towers are conditional uses in B-2 areas subject to a height limitation of thirty-five feet. Thus, the Council at the time of adopting the ordinance did have some specific concepts in mind with regard to television and radio antennas. If the Council decides to change any of the ordinance provisions that I have detailed above, I would recommend that a separate ordinance be enacted which would dea_1 not only with the zoning questions but also per- mit's, fees, construction requirements, _lights, removal of abandoned towers, etc. There is a model ordinance adopted by the City of Bloomington which T believe the Council is aware of. The sign would be erected by members of the Bahai faith and apparently wou ld not be illuminated. Ordinance 64, .Section 14.1, provides that signs :are a permitted accessory use in all use districts but they are subject to the regulations set forth in Section 14. Section 14.1(2) through Section 14.1(2.6) set forth the regulations applicable to sign regulations in all resi- dential districts. Essentially the only signs that are permitted in residential districts are: 1. A nameplate indicating the name and/or address of the occupant; 2. Nameplates for apartments or multiple dwellings which indicate the names of the buildings or project or may be a directory for occupants; 3. Occasional uses. of signs such as for political elections, for sale or for rent or other similar occasional uses. Section 14.1(2..4) states that "advertising signs" shall not be permitted in residential districts. Based on the above sections of the ordinance, my conclusion is that the proposed sign is not a permissible sign within a residential district. It is not one of the permitted signs set forth in Section 14; it is not a sign for occasional use. such as a for sale or for rent sign; and in fact it may be an advertising sign which is specifically prohibited in Section 14. I note from the application that this fact may have already been recognized because the applicant .applied for a variance rather than a conditional use, If the sign is not permitted within a residential district, the next question is whether there are conditions • .present which would justify the Planning Commission and the Council in granting a variance fram the strict application of the zoning ordinance. T would direct the attention of the Planning Commission and the Council to Section 16.4(4) of the ordinance which sets forth the conditions under which a variance may be granted. In essence, a variance shall not be granted merely to serve as a convenience to the applicant but is to be granted where the applicant has shown demonstrable hardship or difficulty sufficient to take it outside of the. strict application of the zoning ordinance. Thus, it is up to the Planning Commission and ultimately the Council to determine whether there are facts present here upon which a variance may be granted to the applicant. Yours truly, "O ~ John R. ICINNEY The Planning Commission and Council have asked my opinion concerning the application of Ordinance 64, the zoning ordinance, to a request by a Mr. Sederberg, 1452 West Idaho Avenue, to erect a forty-foot tower and to install an antenna on the tower for the purpose of receiving and transmitting amateur radio communications under regulations of the Federal. Communications Commission. Mr. Sederberg°s property is located in an area that is zoned "R-l". Section 6.2(5) provides that acces- sory structures other than private garages are permitted uses within an R-1 district but a conditional use permit must be issued for such a conditional use. Under the definition of "structures", I would construe a television or radio tower as being an accessory structure. Thus,. the Council must look at the facts of each application and deter- mine whether a conditional use permit shall be issued. Another section of the R-1 regulations is also pertinent here. Section 6.4(1) provides that no building or structure shall exceed two stories or twenty-five feet in height, whichever is less, except as provided in Section 15 of the ordinance. Section 15 increases the height limi- tations by fifty percent for certain types of structures such as water towers, flag poles, smokestacks, church • ' BRIGGS axn MORGAN • : Mr. Dewan B. Barnes -2- June 18, 1976 towers, etc. There is nothing in Section 15 pertaining to television or radio antennas. Thus, I would conclude: 1. A television or radio tower is an accessory use and. the applicant must secure a conditional use permit' from the Council for such accessory use in an R-1 district. 2. If the Council determines that the applicant is entitled to a conditional use permit, the tower may not exceed twenty-five feet iri height. 3. There is no authority to increase the height limitations by fifty percent under Section 1.5 of.~t:he ordi- nance. 4. The Council could grant a variance and a ,conditional used the conditional use for the basic struc- • ture and the varia~~ice to allow the structure to e~;cecd twenty-five feet in height. The normal variance rules would apply as set forth in Section 16 of the ordinance. In essence, the Council would have to determine whether .there is some definite hardship or difficulty imposed on the applicant and that the request is not simply for the convenience of the applicant. I should note that television and radio stations and transmitting towers are conditional uses in B--2 areas subject to a height limitation of thirty-•fi.ve feet. `T'hus, the Council at the time of adopting tl~ie ordinance dial have some specific concepts in mind wif_h regard to television and radio antennas. If the Council decides to change any of the ordinance provisions that I have detailed above, I would recommend that a separate ordinance be enacted which would deal not only with the zoning questions but- also per- mits, fees, construction requirements, lights, removal of abandoned towers, etc. Tl-iere is a model ordinance adopted by the City of Bloomington which I believe the Council is aware of. Dr. David Silverman, 163 Ninth Street, White Bear Lake, the applicant for the Conditional Use Perr~3.t, read a statement describing his background and outlining his plans for the proposed small a al hospital. He also said he had verbal approval of the hospital from three adjacent property owners/managers. Member Ohman stated his only ob~ek~tion would be waste outside of the building. He said he would like to see a back entrance used rather than the front of the building. Snelling Avenue, Falcon Heights. At this time, I would like to briefly examine the present state of the Veterinary profession. Veterinary Medicine has experienced the fastest growth and more advances in the last 15 years than any other field in the health sciences. Today, the American Veterinary Medical Association recognizes 10 specialty boards. These are: American Board of Veterinary Public Health, the American Board of Veterinary Toxicology, the American College of Veterinary Microbiology, the American College of Laboratory Animal Medicine, the American College of Theriogenology (Obstetrics), American College of Veterinary Opthalmology, American College of Veterinary Pathologists, the American College of Veterinary Radiologists, the American College of Veterinary Surgeons, and the American College of Veterinary Internal Medicine, with • 6 subspecialty boards. Certainly this list is not as extensive as that of our physician colleagues, but most of our specialty boards have only been recognized in the last 5 years. The Veterinarian's image has certainly changed from that of the rural "horse doctor. " In terms of training, Veterinarians expend as much time and energy as an M. D. The Veterinary curricula is 4 years -- the same as human medicine, and most Veterinary colleges offer internship and residency programs. In fact, it is harder to become a Veterinarian: at present, there are only 20 Veterinary colleges in the United States. And, because of the expense involved, class size in all colleges is limited to about 75 per year. In my freshman class at the University of Illinois, in 1970, 80 applicants were accepted and over 600 were tunied away. • Animals and animal care play an ever-increasing role in American life. Aside from food animals and horseracing, the Sport of Kings, pet and companion animals have -2- become a separate major industry. In 1973, an A. C. Neilson survey found that 57.4 • of American families qualified as households with pets. This fact, plus the .small. number of Veterinary colleges, and the limited enrollment capabilities in these schools, have caused a nationwide shortage of Veterinarians, at a time when the need is greatest. The village of Falcon Heights does not have a private small animal hospital. The University college of Veterinary Medicine has a small animal facility, but their hours are limited, waiting lists usually exist for routine services, such as vaccinations, and the Doctor-Client relationship is not as personal as most people desire. As a result, most residents of Falcon Heights must go elsewhere for Veterinary services, such as Roseville or St. Paul. I have discussed my proposal with the Health Board of Falcon Heights. They have recommended in favor of the establishment of this hospital. One item that they • seemed most concerned with was that of waste disposal. I will have only a small area for keeping animals. I will have a floor drain in the kennel area with a pitched cement trough leading to it. In this way, animal waste can be quickly and thoroughly eliminated. I will have no outside kennels. Deceased animals are picked up immediately by a private firm. In fact, far from being a liability, an animal hospital is a Public Health asset to a community. Veterinarians are the first line of defense against zoonotic diseases -- disease transmitted between animals and man. Common examples of zooneses we try to protect against include ringworm, salmonellosis, toxoplasmosis (which can affect fetuses in households with cats) and rabies. Another public health problem which Veterinarians are uniquely qualified to deal with is that of unwanted pets and stray animals. Free roaming stray dogs damage property, spread disease, and are a public nuisance. No one remedy has worked in every community, but pet population control, chemically or surgically, is a service every community should have. -3- ' Historically, the major objections to animal hospitals have been sound and odor control. Modern design and construction techniques have largely eliminated these problems. Specifically, there are several ways I will control noise. First, all the stores in this strip have separate heating and cooling systems. This eliminates sound transmission through the ductwork. I will soundproof the walls with fiberglass insulation and a double layer of sheetrock or soundboard with an airspace in between. This method of soundproofing has proven effective, and has been recommended by Veterinary Economics , a Veterinary journal dealing with construction techniques and solutions to various problems posed by animal hospitals. Also, all doors will be solid core, and, as I mentioned, there will be no outside l:ennels. Hospital capacity will only be 3 dogs and 4 cats. I might add that I have talked with the managers/owners of Shakey's, Frame. Factory and the Clip Joint and have received their approval. Most odor problems will be reduced by the waste disposal system, In addition, I will have 2 exhaust fans in the kennel room, I will have 1 row of stainless .steel cages which will be on wheels so they can be moved and the kennel area thoroughly cleaned. Noxious odars in a hospital imply poor sanitation. Veterinarians today cannot afford to be unsanitary. In conclusion, let me state several other ancillary benefits which I may offer to the Falcon Heights coznmunit5~. For example, xThen i managed the Capital City Animal Hospital in St. Paul., i gave tours to school children. They enjoyed it, and I feel they learned a lot about animals and animal care. I also ans~~aered many questions from high school and college students who had an interest in entering the Veterinary profession. This was all. first-hand information riot readily available from sources other than a Veterinarian. And so, with your recommendation, I hope I can be a valuable addition to your community. • • is ,. During this luncheon, we discussed the Business- men's proposal for upgrading Larpenteur and Snelling Avenues' business district. On June 13, 1975, he wrote me a letter confirming our meeting and, likewise, sent me a Dopy of a lettor he mail©d to rIr. A. C. Godsxard of Minneapolis, ~aho is either a plannflr or aril engin©nr for I~Ir. R~aos, as well as a close friend, and he suggested he gloat with mo. As of this date, we have not consulted each other. Mr. Rees enclosed a copy of his proposal as to what he would do if certain conditions ware met. He .fe©ls the City shou7_d condemn the residential property bohind Flower City for a parking lot. (I do not agree. .This should be acquired by the commercial property owner, if at all.) He feels if the residential area was converted to a parkit~ lot, they would give up the front parking a1ot~ Larpenteur Avenue. Mr. Rees also suggested a hedge 10 feet wide be planted along the south side of Crawford and that there be trees planted and a new sidewalk area along Larpenteur Avenuo. Roll Call: Ayes (6) Nays (0) Discussion; Zoning of Business Area Discussion was held regarding the proposed Businessrntan~s Rezoning Plan and land available for business expansion. Member Larsen suggested that something should be done about, the parking situation in the area of the Flameburger, 1533 West Larpenteur, before ar;ything further was done to update the area. He felt the area should have less businesses and more parking available. He also noted there were no unloading facilities provided for the K and K Hardware Store. Members of the Planning Commission felt that beautification of the existing business area on Larpenteur Avenue was the responsibility of the property owners and not the City. It was their opinion, also, that residents were not really interested in attracting more business establishments to the area. i. • • Planning Commission Minutes February 17, 1.976 The Commission discussed rezoning of the six lots to the north of the business area, which are presently resid®ntial, and the effect. this would have for the owners if they were to sell their homes. It was felt hardships could be caused in selling the property if it were zoned coi~rnercial. The Commission also was of the opinion that snow removal should be itsproved and the area better patrolled. Discussion of Ordinance #6~ Possible changes in Ordinanc® #6!~ were discussed. George Plant, Chairman of the Falcon Heights Planning Commission, DISCUSSION: was present to discuss the functions of the commission. .FUNCTIONS OF PLANNING Mr. Plant said the Planning Commission felt that the proposed C02~A'IISSION Businessmen's Plan for the rezoning of Larpenteur Avenue should not be termed "rezoning", but be termed a "concept". The Plan- ning Commission also was of the opinion that Falcon Heights did not ne®d more businesses on Larpenteur between Hemline and Cleve- land Avenues at the present time. Councilman Steele stated he felt the Commission should present more facts for their recom~aAndations to Council so that the Council would be better informed on issues brought before thew. Mr. Plant suggested that pertinent details relating to raqu®sts that come before the Commission be submitted to the members before the night of their meetings, in order that they may become :Wore familiar with these requests. Councilman Ecklund said he felt requests should be investigated thoroughly by the Commission before they wore presented to the Council. Attorney Kenefick noted that the Clerk-Administrator could refer items to the Planning Commission without going to the Council for their review first. 2 • Discussion was held regarding problems the Commission was having regarding meeting dates. Councilman Labalestra suggested setting one date, perhaps the 15th of each month, as the meeting date. Mr. Plant said he would poll the Commission on this suggestion. The proposed Businessmen's Rezoning Plan for Larpenteur Avenue was discussed. Councilman Steele stated he agreed that existing businesses should try to improve the parking situation and also that the area b® made more attractive and appealing, but that further expansion of the business area should not be promoted at the present time. Councilman Labalestra said that Dan Bucholtz, North S~,burban Area Chamber of Commerce Vice President, was working with the 3usiness- men's Association on plans for the area. The Planning Commission was directed to work on plans for the existing business area and also to communicate with the Business- men's Association on this matter. The Planning Commission reviewed the preliminary plat for the Pothen Homesites Subdivision, ftoselawn and Hemline Avenues, sub- mitted by Nick Pothen, 1877 North Hemline Avenue. The Planning Coraeission recommended approval of the plat at its meeting of January 20, 1976, sub3ect to the following requirements suggested by the Ramsey County Plat Commission: • 1. Approval of the Ramsey County Engineer for use of ~.3 feet dedicated strip instead of 33 feet as shown on the plan; 2. Approval of the Register of Deeds. The additional ten (10) feet is an easement for water and gas installation. APPROVAL OF PRELIMINARY PLAT: POTHEN'S HOMESITES Moved by Councilman Black, seconded by Councilman Ecklund to accept ".the Planning Commission report as submitted recommending approval of the preliminary plat for thr~ Pothen's Homesites Subdivision. Also PRESENT present were Clerk-Administrator Barnes, Engineer Lemberg, and Attorney Kenefick. Councilman Ecklund. ABSENT Clerk-Administrator Barnes administered the Oath of Office to OATHS OF Willis C. A. Warkentien, re-elected F4ayor of Falcon Heights. OFFICE Clerk Administrator Barnes administered the Oath of Office to William H. Black, re-elected Councilman of Falcon Heights.. Councilman Black reviewed the request for a variance submitted November 18, 1975, by Milton I~Zoore, President of Mando Photo Company, 1790 West Larpenteur Avenu©. The application is for a 30 foot variance from the front yard setback and an 18 foot variance from the side yard setback to allota for construction of an addition to the front of the building. Councilman Black read a letter from Mr. Moore, dated November 18, ~~ 1975, addressed to the Planning Commission, in which Mr. Moore states the reasons for his request for a variance on both the front and side yards. Councilman Black also read the minutes of the Planning Commission meeting of December 2, 1975, at which time the Planning Commission recommended that the variance be granted. Milton Moore stated that if the variance was not granted, his firm would eventually have to relocate, as the additional space was needed in order to continue operation. He requested that the Council make a decision on the variance this evening. Attorney William Korstad, 162,5 Garden, said he was representing James Boyd, owner of the apartments immediately to the west of the Mando Photo Company. NIr. Korstad felt that granting the variance would establish a precedent for future variance requests along Larpentaur Avenue.
