I am writing. this letter on my own behalf in as much as I am in the real estate business and z clo n~ject to the zoning from R-1 to R-2 and the following will be qty reasonsfortheobjection: 1. In most cases contractors. and or promoters build duplexes and double bungalows for the business of retaining ownership of the properties for a very short period of time whereafter the bontractor or promoter will attempt to sell the property • when it goes on the tax roles and full taxes become due and :. payable, Before the property goes on the said tax roles the rents can be derived from tenants without making arty tax pay- menu--in some cases between a yeas or a year and a half. This policy in our business is called creaming the top. During this period of'time the selection of tenants is normally not desirable. When this situation arises in as-much as these tenants do not have a, vested interest in the property the property is not main- ta3.ned as _ it should be. 2. In many ' cases a new investor will put a very small amount of money :down so that in .the event the-property is not cared for or kept up by him because of his lack of interest in the property the property ,'. becomes deteriated and becomes an eyesore for the rest of the com- '~ munity. 3. The 'only time that a duplex or a double bungalow becomes actually feasible is when the purchaser actually occupies the property. and rents the other unit out. Normally in a situation. Page. 2 - ~etober 23, Y973 -~,. of this sort the owner occupant does have a vested interest and normally in most cases the property is kept up faith some ex- ceptions. "If the owner occupant has had no previous experience than. thatof a landlord they normally rent to tenants who have not been screened out. Consequently, the .same situation as I .pointed out in paragraph one and.two prevails. ~F.' I drrite you this information and I realize that there are exceptions to the points I have stated above, but I do believe that they are a few and far between. I highly recommend to the council and to the planning board that they do not rezone the property to R-2 and continue ,to have it zoned as R-1. I am sure that the parties who ha~ejiseived notice of the applica- tion to rezone have had their homes built with the idea in mind that the land involved would eventually have sir~le family residencies rather than duplexes or double bungalows adjacent to them and their concern is that if this property is rezoned there is a. possibility. their property could depreciate in value j or that at the time of-sale they could not realize the amount that normally could have if the property remained as is. The legal description of the property (hereinafter called Pothen Property) for which an application has been made for rezoning is as follows: • That part of the Ne~/a of the SWyv of Sec. 15, T.23, R.23, lying E'ly of the plat of Klatt's Addition No. 2, and N~'ly of Ruggles Street and S!1y of Roselawn Avenue. We are opposed to this rezoning for the following reasons: 1. No Need For Such Rezoning. No evidence of need has been presented to justify the rezoning of the Pothen Property. All property for sale within the past five years for the building of single family dwellings, located near the Pothen Property has been sold within a reasonable amount of time. We feel that the applicant for rezoning should have the burden of showing that a real need exists for the change. 2. Homes Built In Reliance Uf Continued R-1 Zoning. The present homeowners in the immediate area of the Pothen Property built their homes with the assurance that this property would remain zoned R-1. 3. Most Renters Have ?Jo Long-Term Vested Interest In The Rental Property. Two-family rental units create a greater turnover of residents than do individually owned single family homes. Since renters have no long-term vested interest in the rental property, such property is more apt to i~ . -2- • become run down and lead to a reduction in the value of adjoining property. 4. Rapid Turnover Of Residents Reduces The Quality Of Life In A Community. The quality of life in any community is greatly dependent upon the lasting relationships of the people who live there. Such relationships are lessened by the rapid turnover of people. The short-termed residency of renters tends to prevent them from developing lasting relationships with neighbors and from having a continued interest in the Falcon Heights Community as a whole. California, were present at the meeting to explain that they would. like to add. three feet to the rear of their garage in order to get their car into the garage. The addition would put the garage just three feet from the neighbors lot line. They had with them a letter from the • neighbor indicating that he had no objection to the addition. The Reiters plan to finish the exterior of the new addition with the same materials as the present structure so that it will look appropriate. On motion by Berdie, seconded by Schwantes, the Planning Commission voted unanimously to recommend to the Village Council that they approve the application for a variance. Ronald A. Nelson: Mr. Nelson of 1764 Asbury would. like to build. a new one car garage within three feet of his neighbor's pro- • party line on the south side of his lot. If he allows for. the 5 foot set-back he will not have enough ~ga~ce .,~o build the garage. His sketch showed that the neighbors garage is presently three feet from his lot line. The ordinance incorporates a number of provisions found in both the Richfield and the Blaine ordinances, but elim- mates a number of the building requirements which I felt . _ were superfluous, due to the existence of the state building code which is in effect for the. Village of Falcon Heights. There are provisions in the ordinance with which the present applicant might be impossible to comply. Mr. Barnes has told me that they desire only male customers, and will be using .female employees to do the massages. Under the ordinance, the-premises must be open to all persons, and the massages can only be done on females by females, and on males by males. This provision is in the Blaine ordinance. I spoke. with their Village Attorney, and he informs me that that clause has not. been challenged incourt. I am of the view that such a provision is a legitimate. excercise of the police powers of the Village, in order to protect the welfare of the inhabitants of the. Village, If you have any amendments, changes or suggestions concerning this ordinance, please let me know by Tuesday or Wednesday of next week, so ..that I can have it re-drafted for the Thursday meeting. "The Village Council of Falcon Heights does ordain as follows: SECTION 1 •• Purpose and Policy The purpose of this ordinance is to regulate the opera- tion of saunas, steam baths, heat-bathing rooms, and other forms of commercial establishments wherein massages are given. The Village Council deems the unlicensed and uncontrolled operation of said establishments to be a public nuisance, and a danger to the health, safety, and welfare of the in- habitants of this Village. SECTION 2 Definitions a. The term "sauna" means and includes a commercial •steam bath or heat-bathing room used for the purposes of relaxation, physical fitness, or beautification, utilizing steam or hot air as a cleaning, relaxing, or reducing agent. The term shall also include all structures and/or rooms contiguous or connected to the steam bath or heat-bathing room. b. The terms "massage," "masseur," and "masseuse" shall have the same meanings as set forth in Minn. Stat. .Sec. 148.33 (1971). Said definitions are hereby .incorporated by reference. c. The terms "person" and "licensee" shall mean and include all natural persons, together with all corporations, partnerships, associations and other business entities. "~ SECTION 3 , .: License Required ' No person shall engage in the business of operating a sauna, either exclusively or in connection with any other business enterprise without being licensed as provid~'d in this section. SECTION 4 Contents of Application Application for a license shall be made to the clerk- administrator. There is any deception, misrepresentation, conceal- ment or fraud involved in the license application; d. The applicant or any person in his employment has been convicted of any crime or offense, other than a -traffic offense, or has a history of non-compliance with the laws and ordinances that pertain to health, safety, or moral turpitude of this Village or other cities and villages. SECTION 8 .Grounds for Revocation of Licenses The. Village Council may revoke a license previously. ,granted if any one or more. of the following grounds are found to exist: a. The. licensee or any person in his employ is found. to be in control. or possession of any alcoholic beverages or narcotic drugs, or controlled substances of any type on the premises, possession, and/or use of which is illegal under state or federal law; b . The Village Council of Falcon Heights does ordain as follows: SECTION 1 Purpose and Policy The purpose of this ordinance is to regulate the opera- tion of saunas, steam baths, heat-bathing rooms, and other forms of commercial establishments wherein massages are given. The Village Council deems the unlicensed and uncontrolled operation of said establishments to be a public nuisance, and a danger to the health, safety, and welfare of the in- habitants of this Village. SECTION 2 Definitions a. The term "sauna" means and includes a commercial •steam bath or heat-bathing room used for the purposes of relaxation, physical fitness, or beautification, utilizing steam or hot air as a cleaning, relaxing, or reducing agent. The term shall also include all structures and/or rooms contiguous or connected to the steam bath or heat-bathing room. b. The terms "massage," "masseur," and "masseuse" shall have the same meanings as set forth in Minn. Stat. Sec. 148.33 (1971). Said definitions are hereby .incorporated by reference. c. The terms "person" and "licensee"shall mean and include all natural persons, together with all corporations, partnerships, associations and other business entities. • i• SECTION 3 License Required No person shall engage in the business of operating a sauna, either exclusively or in connection with any other business enterprise without being licensed as providd'd in this section. SECTION ~1 . Contents of Application Application for a license shall be made to the clerk- administrator. The application shall contain a description and plan of the property to be used, the names and addresses of the owner, lessee, if any, and the operator or manager. The application shall further indicate whether the applicant, the manager or operator, has ever been convicted of a crime or offense other than a traffic offense, and if so, informa- tion as to the time, place, and nature of such offense. The application shall contain such other and further information as the clerk-administrator deems necessary. • SECTION 5 Licensee and License Year The annual license is $150.00. A separate license shall be obtained for each place of business. The licensee .shall display the license on a prominent place on the premises at all times. A license, unless revoked, is for the calendar year or part .thereof for which it has been issued. SECTION 6 Granting or Denial of Licenses License applications shall be reviewed by the clerk- administrator and such other departments of the Village as the clerk-administrator shall deem necessary. Thereafter, licenses shall be granted or denied by the Village Council subject to the provisions of this ordinance. The license fee shall be payable only after the grant of a license by the Village Council.
