Section 1l~.1 (l~.5) requires a conditional use permit. A.1.so, the Robert Hall application requires a variance, as the added sign on the same standard puts the total over 100 square feet, which is prohibited by Section ].lt.l (l~.l) of Ordinance 6l~. Perhaps these can be handled without a great deal of discussion. This application involved the construction of an attached garage on the north side of his lot which would be built up to three feet of his north lot line, The Planning Commission considered the application incomplete and did not consider it because no permission from the neighbor to the north was submitted. Since that time, hir. Helms has indicated a desire to change his plans and now wishes consideration for a detached garage to be built four feet to the rear of his residence and he requests a variance to allow him to build this detached garage within 1~ feet of the same north property line. T This was discussed at the council on September 1l~, 19156 and we have no alternative other than to make a re-referral to the Planning Commission and I world ~~taisly appreciate this being considered in the near future. Initially, it appears that Mr. Helms is asking us more than he asked for at the time of his first submission for variance. Perhaps this i~o~rltirely true as there do appear to be some points in his favor. There some things which are perhaps worthy of some con- sideration and can probably be discussed in detail at the ~,ime we can arrange a meetings 1. the ~definitions~ section of the ordinance is really not entirely clear as to whether or not it applies to a detached garage built to the rear of the house. 2e ~[r. Helms was allowed to build a cement driveway to a distance of several inches from the north lot line and this was appa~oxisnately two years ago, 3. Yr. Adr. rind hrs. Art Lindig were present and answered questions about their applica- tion for a conditional use permit to use their home at 1875 ~N. Larpenteur as a rooming house for University studenta. They have talked with Adrs. Jlsen of the University Housing Bureau, wlio is in charge of housing of St. Paul campus students. ?hrs. Olsen informed them that their house could accomodate up to six students, as it has just one stairway to the second floor. fir. Lindig assured the Planning Commission that there was adequate parking space available. ~&OTI©N ll~r. Larson moved to recommend to t3~e Village Council that a conditional use permit be granted tv Mr. Lindig to use his home as a rooming house for up to and including six people. fir. Sch~vantez seconded the motion, ~rhich was passed. It was recommended further that the Village Council request the Fire Department to chee% the home periodically for fire safety. 2. '~ebers Restaurant ~at 1708 1J. Snelling Ave. rec~ussted a varis~nce for a ns~r sign. 3' by 18~ sign will be erected on the top of the building and a 6~ by 8~ reader panel gill project from the front of the building. The over-all s~aare footage for the signs is 2 s~.. ft. more than allowed by the ordinance, end the reader panel projects 6 fret closer to tie front property lot Tins then permitted by the ordinance. The Planning Cor~:miasion felt that the proposed sign ~a.s appropriate. pith the Embers sign next door, this sign seemed reasonable, ?~"OTION fir. Hindermann moved to recommend to the Village Council that the re- quest for variance for a new sign submitted by '~ebers Restaurant at 1708 N. Snelling .Ave. be approved. ~Itr. Larson seconded. The motion was passed. 3. The application for a variance submitted by &fr. `~. ~P. Helms, 1789 :Asbury, was discussed next. fir. Helms wants to add a garage and additional bedroom space to his home. The structure would come to ~rithin 3~ of the let line of the neighboring Hus+eby lat. The Huseby house is about 35~-from the lot line so there would still be space between the houses. The Planning Commission took no action on the regue$t as they felt two more documents were needed before consideratian~ 1) the ~rritten consent of tt~e neigh- bor involved, (the Hus+eby family) and 2) an elevation drawing of the proposed structure shoring the roof fine .and the overhang. ~. ~Ir. Rubinger were present to explain their plans for an 120 unit apartment complex to be built on the Itillmer propertiest They are requesting a conditional use permit for R_3 on B-T„-:~ zoned property. It was noted that tu~o parking spaces are within the ~0~ front yard set- back, and gnat theie were ;taarking spaces in front of each of the entrance ~aoorways to the bu~.ldingG. These minutes have not been approved as yet, but I was instructed to advise you of their action. «9VHEREAS, Art Lindig has made an application for variance and filed the same with the Village of Falcon Heights along with the fee of X5.00, and WHEREAS, the matter has been referred to the Planning Commission for the Village of Falcon Heights, and WHEREAS, the Planning Commission has recommended. that said application be denied by reason of the followings (a) The lot size is 5,700 square feet instead of the required 12,500 feet. (b) The construction of a dou'ole bungalow on part of the same lot which now has a greenhouse means two buildings on one lot which is prohibited. (c) The plan proposed shows only one garage. (d) The back yard set back is only seven feet instead of the required thirty feet. NOW, THEREFORE, BE IT RESOLVED THAT THE VILLAGE COUNCIL OF THE VILLAGE OF FALCON HEIGHTS denies the variance application made by Art Lindig on the 23rd day of February 1966 for use of that property described. as Lot 1, Block 1, Lindig First Addition located north of and adjacent to Lindig's Greenhouse at 1875 West Larpenteur Avenue, which property is presently zoned as R-3, all under the provisions of Section 16.05, Ordinance No. 6!~ of the Village of Falcon Heights for the following reason: Said variance is not in harmony with the general purpose and intent of the ordinance and comprehensive plan of the Village of Falcon Heights.
