You will recall that originally there was a plan for a 17-unit apartment, which required re-zonin Coannission and the Council denied that. After the denial, alp and was submitted for the 12-unit apartment building covered in the at- tached p~.ans and this was ap proved with a six-unit garage. In the meantime, there has always been the problem of ~indig~s application to subdivide this property. Unfortunately, a building permit did get issued_-but the Planning Commission and the Council both have refused to approve his application for a subdivision permit, Garley seems to be an innocent party in all this. He applied for a building permit and one was issued. Bows h.e wants a garage to provide 11-unit previously Proposed 6-unit buildi Parking instead of the ng. In order to get this aceomp~ished, he will have to invade the set-back requirement on the southeast corner of the lot by arranging two parking spaces immediately east of the posed extended garage. Plant, Chairman Planning Commission 1861 Moore Street Falcon Heights, Minnesota Dear Mr. Plants Re: Collin Alexander Fence Variance Application - 1868 Arona This matter was considered at the regular meeting on May 26, 1965, and it was decided further information was needed and this was obtained and..a special meeting was held May 28, 1965 at which meeting the application for a variance eras approved. Howard Dahlgren, planning consultant was contacted. He indicated that the thirty foot set-back was placed in the ordinance for two reasonss (1) to provide protection against possible traffic hazards which might be created by erection of a fence too close to intersecting street, and (2) to protect the interests of an adjacent property. owner to the rear, who may be facing the side street (Ruggles, in this case). On the basis of the Councilts inspection, it appears no traffic hazard would be created.. It also appears that there is no property owner to the rear facing on Ruggles. In fact, that property owner has a garage located very close to Ruggles, and he has given written assent to the variance application. The Council does not feel that the application should be granted based on the above two considerations alone. The character of the area must be considered, and it is to be noted that there are several residences located within ten feet of the lot line adjacent to Ruggles, and one is approximately five feet distant. Further, many residences have substantial growths of shrubbery right on the lot line. If, however, other residences in the area were in compliance with the set-back require- ments, the Council would not be interested in making an exception in this case. We think the above matters would have strong persuasive force if we decided not to approve the request and the property owner decided to carry the matter further. The fence will be located 30 feet north of the center of the street, It will be a woven steel type fence, just under six feet in height . Arona, has indicated he will be submitting a variance request along with plans for a f ence, six feet high, on the side and rear yard of his property. I thought I might write this up informally, so when the request dose come, it might not be necessary to have a meeting just for this one pur- pose. Alexanderts property is on the northeast corner of Ruggles and. Arona. He wants to fence the south side of his rear yard. He wants to place the fence as close to his lot line as possible. The nepr proposal shows 1.38 parking stalls per housing unit. This requires a variance from the 1.5 parking stalls as required by the ordinance. Regarding the Larpenterrace proposed apartments: - - Gordon Nelson of the fire department reviewed plans for access of fire equipment and location of fire hydrants. He recommended four hydrants along east access road distributed uniformly near entrances to structures. Larson suggested that lights be provided in the parking lots and parking stalls be provided with receptacles for enging heaters. Parking stalls should be plainly marked. It is recommended to the Council that approval of the conditional use permit be made, that the variance to the parking ordinance be approved providing that the garages be eliminated to provide ten additional parking spaces. (Ratio: of parking stalls to housing unit will then become l.l~2.) It was felt that diversity of parking in an apartment development of this size will probably not require as many parking spaces as will a smaller one. It is suggested that the building inspector should check with the fire chief on hydrant and access requirements. Adequate lighting should be provided for al.l parking lots.
