I have reviewed the matters under consideration at that meeting, and call to the attention of the Planning Commission the following provisions of Ordinance No. 6~+, which may be of some assistance to you in your discussions and deliberations: 1. The property located at the northeast corner of Tatum and Larpenteur Avenue is presently zoned R-3. The principal prob- lem before the Planning Commission will be to determine whether the proposed project complies with the regulations of the Village of Falcon Heights relating to multiple dwelling units. The property is presently zoned R-3 and of course can be used for multiple dwell- ing purposes. 2. The property adjacent to Weberts cottage proposed to be used as a used car lot is presently zoned B-2. T'~" ~ "~--~°' --' °' ~„ means the division of a parcel of land into two (2) or more lots or parcels for the purpose of transfer of ownership, or building development; or, if anew Street is involved, any deviaion of a parcel of land; provided that a division of land for agricultural purposes into lots or parcels of five (5) acres or more and not involving a new street shall not be deemed a subdivision. The term includes reaubdiviSion and, when appropriate to the context, shall relate to the process of subdividing or to the land subdivided, 1.2 Streets and Alleys. The term "Council" means the Village Council of Falcon Heights. r2r 4 ~ ARTICLE II PROCEDURE FOR PLATTING LAND Pre-application Procedure 2.1 Previous to the Piling of an application for conditional ap- proval of the Preliminary Plat (General Subdivision Plan), the Subdivider shall submit to th® Council plans and data as specified in Article IV. This step does not require Formal application, fee, or filing of plat with the Council. 2.2 Within fifteen (15) days the Council shall inform the Subdivider that the plans and data as submitted or as modified do or do not meet the objectives of these regulations and ordinances. When the Council finds the plans and data do not meet the objectives of these regula- tions it shall express its reasons therefor, 2.3 If the plans or data submitted bythe Subdivider, as submitted or modified, meet the ob,~ectives of these regulations, and the ®xist- ing ordinances of the Vi118ge, then the Council shall refer said plans and data to the Planning Commission for their atiuly, consideration and recoanmendations, all with due regard to the pravisiona of .the regulations contained her~sin and other ordinances of the Pillage. Procedure For Conditional Approval of , Preliminary Plat __~ ~~~~r.~r-rrr ~ ~ r- 2.4 On reaching conclusions informally as recommended above regarding his general program and ob3ectives, the Subdivider shall cause to be ~3- w ~ prepared a Preliminary Plat, ,together with ,improvement plans and other supplementary material as specified in Article V. 2.5 Three {3) copies of the Preliminary Plat and supplementary material specified shall be submitted to the Council with written application for conditional approval at least ten (10) days prior to the meeting at which it is to be considered. 2.6 Following review of the Preliminary Plat and other material submitted for conformity thereof to these regulations, and negota- tions with the Subdivider on changes deemed advisable and the kind and extent of improvements to be made by him, the Council shall, within thirty (34) days, act thereon as submitted, or modified, and if approved, the Council shall express its approval as Condi- tional Approval and state the conditions of. such approval, if envy, or if disapprov®d, shall express its disapproval and its reasons therefor. 2.7 The action of the Council shall be noted on two copies of the Preliminary Plat, referenced and attached to any conditions deter- mined. One copy shall be retwrned to the Subdivider and the other retained by the Council. 2.8 Conditional Approval of a Preliminary Plat shall not constitute approval of the Final Plat (Subdivision Plat). ARTICLE III PROCEDURE FOR DIVIDING EXISTING LOTS OR CONVEYING BY METES AND BOUNDS DESCRIPTIONS 3.1 Prior to the filing of an application for conditional approval of the proposed subdivision of an existing tract of land, either by division of an existing lot, or metes and bounds description of an existing tract, the Subdivider shall submit to the Council plans and data provide8 in Section V herein. This step does not require formal application, fee or filing of plat with the Council. 3.2 Within fifteen (15} days the Council shah. inform the Subdivider that the plans and data as submited or as modified do or do not meet the ob~ectivea of thes® regulations and ordinances. When the Council finds the plans and data do not meet the ob~eetives of these regula- tions it shall express ite reason$ therefor. 3.3 If the plans ar data submitted by the Subdivider, as submitted or modified, meet the ob3ectives of these regulations, and the existing ordinance$ of the Village, then the Council shall ref®r said plans and data to tho Planning Commission For their study, consideration and recommendations, all with due regax~dr~:ato the pro- visions of th~3 regulations contained her®in and other :oi~dirances of the Village. ..~. ~. PROCEDURE FOR CONDITIONAL APPRpVAL OF FRELIMINARX PLAT 3.~ R~ reaching conclusions informally ae recommended above regar8- ing his general program and obJectives, the Subdivider shall cause to be prepared a Prelimsnary Suzw®y, together with improvement plans and other supplementary material ss specified in Article VI. 3.5 Three (3) copies of the Freliminary Survey and supplementary material specified Sha11 be submitted to the Court with written application for conditiinal approval at Yeast ten (l0) days prior to the meeting at t~rhich it is to be considered. 3.6 Following review of the preliminary survey and other material submitted for conformity thez~e3of to the existing regulations and ordinances of the Village, and negotiations with the Subdivider on changes deemed advisable, and the kind and extend of improvamentS to be made by him, the Council shall, within thirty (30) days, act thereon an Submitted or modified, and if approved, shall refer the Preliminary Survey to the Planning Commission for its approval or disapproval, and if disapproved, the Planning Camtnission end Council shall express its disapproval. and the reasons therefor. 3.7 The action of the Council shall he noted on two copies of the Preliminary Survey, referenced and attached to any conditions deter- mined. Rather it shall be deemed an expression of approval to the layout sub~i-tted on the Pt*~liminary Survey as a r~w .. guide to the preparation of than Find Survey which will be submitted for approval of the Council and for recording upon fulfillment of the requirements of these regulations and the conditions of the Canditianal Approval, if any. ARTICLE N DE.SIQN STANDARDS St ~.1 The arrangement, character, extent, width, grade, and location of all streets shall conform to the General Community Plan and sha11 be conttirlered in their relation to existing and plann®d streets, to topographical conditions, to public convenienc® and safety, and in their appropriate r®lation to the proposed ua®$ of the lan8 to be served by such streets as well as the existing Rules and Regulations for Platting and ordinances of th® Yillgge. ~.2 Minor streets shall be ao laid out that th®lr use by through traffic will be discouraged. ~+.3 Nhere a subdivision abuts or contains an existing or proposed arterial street, the Council may require marginal access streets, reverse frontage with screen planting contained in a non«access reservation along the rear property line, deep lots with rear service alleys, or such oth®r treatm®nts sa may be necessary for adequate ~~ k, ~` protection of residential properties and to afford separation of through and local traffic. 4.4 WYlere a subdivision borders on or contains a railroad right- of•way or limited access highway right-of-ways the Council mqy require a street approximately parallel to and can each side of such right-~of-way, at a distance suitable for the appropriate use of the intervening land, as for park purposes in residential districts, or for commercial or industrial purposes in appropriate districts. Wherever a half street is ad3acent to a tract to be subdivided, the other half of the street shall be platted within such tract. 4.13 Dead-end streets, designed to be so permanently, shall not be longer than x}00 feet and shall be provid@d at the closed end with a turn-around having an outside roadway dia~-eter of at least 80 feet, and a street property line diameter of at least 100 feet. -31- ,. 4.1~i No street zu~mes shall be used which will duplicate or be con- fused with the names of exiatin~ streets. It shall show all existing con- ditions required above in Section 5.3, Topographic Data, and shall show all proposals including the followings a. Streess names; right-of-way and roadway widths] approxi~ mate gradients] similar data for alleys, if any. b. Other ri6hts-of-way or easements location, width and purpose. c. Lccatlon of utilities, if not shown on other exhibits, d. Lot lines, lot numbers and block numbers. e. Sites, if any, to be reserved or dedicated for parks, playgrounds, or other public use. f . In grunting variances and modifications, the Council may require such conditions as trill, in its ~ud~nent, secure substantilly the objectives of the standax~is or requirements so varied or modified . 7.~ Effective Date. The property is proposed to be used as a service station site. 2. The land is presently zoned R-3, Multiple l~~+mily Residence. 3. The proposed zoning distirct classification is B°29 Retail Business. Permitted uses in B-2 Districts include retail business and services with service stations being a conditional use. 4. The existing land use and zoning; of the area are as indicated on the accompanying sketch: a) The area to the north is sia~gle family residential; b) The land to the west is the site of an apartment house and is Zoned for such use; c) The area to the east across Fairview Avenue is vacant and zoned for "Limited Business"; dj Land to the south across Larpenteur Avenue is in public (University of Minnesota] agricultural tssc or is vacant in terms of urban ~ land use; and e) Land to the southeast across Larpenteur is zoned far "Limited Business and Processing" and contains a mixture ~f such uses and single family residences. " 5. Except for florist shops, there are not intense business districts (B-2 Zoning District) or uses in the vicinity of the intersection of Larpenteur and Fairview Avenues. 6, Although Larpenteur Avenue is and will continue to be a major thoroughfare, Fairview Avenue is likely to remain as a Collector type street with a minimum of through-traffic. 7. The Village of Falcon Heights has a Comprehensive Zoning Plan that was prepared with due consideration for over-all Community land use needs and such zoning does not recognize the site in question as being suitable for inclusion in the B-2 Zoning District. PLANNING CtRtSIDERATIONS I. The property is proposed to be used as a service station site, 20 The land is presently zoned R-3, Y~Iultiple Family Residence. 3. The proposed zoning distinct classification is $-2, Retail Business, Permitted uses fn B-2 Districts inr.Iude retail business and services with service stations being a conditional use. 4. The existing land use and zoning of the area are as indicated an the accompanying sketch: a) The area to the north is single family residential; b) The land to the west is the sf.te of an apartment house and is zoned for such use; c) The area to the east across ~'si.rview Avenue is vacant and zoned fez "Limited Business"; d) Land to the south across Larpenteur Avenue is in public (University of Minnesota) agricultural use or is vacant in t~:rms of urban land use; and e)r Land to the southeast across Larpenteur is zoned for "Limited Business and Processing" and contains a mixture of such uses and single Family residences. 4 5. Except for florist shops, there are not intense business districts (B-2 Zoning District) or uses in the vicinity of the intersecvion of Larpenteur and Fairview Ave~~ues. 6. Although Larpenteur Avenue is acrd will continue to be a major thoroughfare, Fairview Avenue is likely to remain as a Collector type street with a minimum of through-traffic, 7. The Village of Falcon Heights has a CoragrehensivQ Zoning Plan that was prepared with due consideration for wen-all Community land use needs and such zoning does not recognise the site in question as being suitable far inclusion in the B-2 Zoning District.
