Schunlcht Midway Constructr:on Larpenteur AvenuE; ' Falcon Heights, Minnesota File 6044 Gentlemen: We have reviewed the above. subject plans, as requested by the Falcon Heights Village council at the meeting of Thursday, October 26, 1972. This plan is basically the same plan as submitted by Mr. Arthur Jurgenson and reviewed as reported in our letter of May 20, 1970 with the exception that one apartment has been deleted and in its place is a roof patio deck. The present plans are more eomplete in that several detail sheets are included, however, such items as heating, ventilating, duct work, electrical circuiting, etc. are not included. We have not reviewed the plans as the building but rather to determine compliance or non-compliance with the zoning ordinances. It is recommended that the plans be submitted to the Building Inspector, the Plumbing Inspector and the Electrical Inspector for approval prior to granting a building permit to assure complete compliance with the Uniform Building Code, the State Plumbing Code and the State Electrical Code. It is also suggested that such things as the roof top wood deck be carefully reviewed for safety and poss- ible fire hazard if used for outdoor cooking. The plan is signed by a Mr. James W. Fischer as a professional engineer, Minne- sota registration Number 7948. Following are our findi-~gs in accordance with Ordinance to. 54t 1. The site location is presently zoned B1A -Limited Business and Processing District. Therefore a conditional use permit would be required. 2. The height of the proposed apartment building shown is 26'-1d-7/8", three story. 3. Total land area involved is 25,823.11 sq.ft. or 0.5928 acres. 4. The plans call for 17 single bedroom units therefore the total lot area required based on the ordinance requirement of 1500 sq.ft. per unit is 25,500 sq.ft., which is just 323.11 sq.ft. less than the land area provided. The ordinance calls for a side yard setback of 10' or 1/2 the height of building, whichever is greater therefore side yard required in this case is 13' S~". This plan shows a side yard setback of 13'-6" for the apartment building, however the garages are shown with only a 5' setback therefore this would require a conditional or special use permit. 6. The ordinance requires 1.5 parking spaces per unit therefore 26 spaces are required. The site plan shows 5 garages and 21 open spaces. Several of the spaces shown are quite small (just within ordinance) and with the new cars with extended bumpers these spaces may now be too small. In addition several of the spaces shown are difficult to reach and also six spaces are parallel parking adjacent to the driveway. In the winter snow removal will be a problem since no space is left on the entire lot for storage. 7. The ordinance calls for a maximum driveway width at sidewalk line of 24'. The plan shows 26'. The plat plan submitted is inadequate. The following items are not shown: 1. Elevations -both existing and proposed 2. Provisions for surface drainage 3. Landscaping and planting 4. Sidewalks, sidewalk widths, etc. 5. Existing features to remain such as street and sidewalk on the north. Because of surface water drainage problems in this area it is quite important that adequate planning for this be considered. Adjacent structures should be shown to determine the affect on neighboring property. ' The layout as presented leaves no space for snow removal and storage, therefore in the winter the parking lot would decrease in size and force residents to park elsewhere. Parking on Larpenteur Avenue is discouraged. Almost 507. of the spaces shown are small. Experience has Shawn that people tend to park in the garage only in bad weather. Other times they park in someone elses parking spot thus decreasing the capacity of the parking lot. Many apartment buildings being built today provide means of plugging in automo- ~bile engine heaters. This would be quite difficult in this case. Parallel parking on the west side would be undesirable to the neighboring proper- ty because of aesthetic reasons. Page 2. a Village Council November 2, 1972 Village of Falcon Heighta St. Paul; Minnesota 55113 Re: File No. 6044 No storage areas are provided for the residents, Laundry rooms are small and only provide for 2 washers and 2 dryers for the entire building. No basement is provided. The Uniform Building Code would require a stairway to the roof, and several other items of construction that are not herein included. It is our recommendation that very careful consideration be given to this plan by both the Council and the Planning Commission and that all aspects be care- fully reviewed before a final decision is made as to the disposition of this request. Falcon Heights Planning Commission Gentlemen: I am unable to attend your meeting on October 10, 1972, but am concerned with plans to rezone Lot 3, Block 1, Lindig`s 3rd Addition, Village of Falcon Heights, from an R-I one family resident to an R-2 one and two family resident. In 1967 I purchased Lot 1, Block 1, Lindig~s 3rd Addition and constructed a dwelling with the understanding that all of the third addition was honed as one family property. There was one apartment unit on the street at that time, but I was assured by Mr. Lindig that no additional multiple units could be constructed. Multiple family units are not usually resident owned and occupants of non-owned dwellings seldom have neighborhood or property interests. If Mr. Lindig were to construct a double bungalow to owner occupy and serve as a buffer between the one family residents on the street, and the commercial property on Larpenteur Avenue, I could see some long term value, but properties change ownership and I do not approve a rezone situation. We need look no further than 1711 Lindig Street to see what can occur when code changes are permitted for specific lots. The driveways of all the dwellings in Lindigts Third Addition are constantly being used as turn-arounds for occupants and visitors of the current apartment unit. A public hearing to consider the application from Mr. Art Lindig to rezone Lot 3, Block 1, Lindigts 3rd addition (88.385' x 289.45~)`from R-3 to R-2 was called to order by Chairman Plant at 8:10 p.m., October 10, 1972, at the Village Hall, ~;1 Ntr. Lindig's lot abuts an R-3 district and he would. ,like to have 3t re-zoned to - R-2 in order that a double bungalow could be built on it. '(Re residents resent` P at the meeting spoke in opposition to the re-zoning.: Their statements covered -.the following pointsz'1) rezoning the lot jaould lower the value of the neigh- boringhomes; 2) a double bungalow might lead to traffic problems with pang on the street, as the bungalow might be rented to as many as .four students in each unit; 3),the re-zoning of one lot might lead to requests for r®-zoning of ." other lots near it. ~ The Funning Commission members found it difficult to appraise the results of re-zoning without a clearer picture of just how the lot would be used. If a definite sketch of the type of structure to be built were presented, the decision of whether or not to re-zone would be more meaningfully made. Hence, Mr. Larsen moved that the Planning Commission recommend to the Village Council that, they deny Mr. Lindigts request to re-zone unles9 he could show ghat the plans for the building to be built are such that it would not depreciate the value of the .adjacent lots. The motion passed. with only Mr. Ohman voting against it. However, after discussion of the motion, it was rescinded, and a new motion made. Nir. Larsen moved that the Commission recommend to the Village Council that they deny the application of Nir. Lindig to re2one his lot from R-3 to R-2. The motion passed unanimously. The public hearing. was then dismissed, and the Planning Commission met to discuss. the r.:unicipal liquor store. Mr. Black read wo letters, one from the architect,: dated Aug. 30, 1972, and one from the Village attorney, dated Cctoher 10, 1972. Both letters concerned deviations from the Village ordinance in connection with adapting '~eber's Inn for a liquor store... The Planning Commission `discussed the ` problems and took action to recommend to the Village Council that they approve the extensior, cf non-conforming uses as indicated in the attorneys letter, as well as approving the variance for parking spaces: from 12 to 11 as indicated. by the attorney. Two additional recommendations were made to the'Council. Inasmuch as the per- mitted uses and the conditional: uses for a B-2 Retail Business District are carefully listed in Sec. 11.1 and Sec. 11..2 of the Ordinance, the Commission ~! recommended the addition of "liquor sales' to Sec. 11.1. Although we were not reviewing this plan as the Building Inspector several items were apparent that are mention- ed below that should be carefully considered by the necessary reviewing bodies of the Village. Although the Village has not adopted the Uniform Building Code several items were checked against said code since it is felt that the present Village Building Code is quite deficient at this time. Those items to which this applies are separated below. The first thing that was noted is that. the plans were not designed or drawn by a registered architect or engineer. Chapter 326.02 of the 1967 Minnesota Statutes requires that for. the health, safety and welfare of the public a building such as this must be designed by a registered professional architect. The plat plan submitted is very inadequate -contour. The following items are not shown: L Elevations - both existing and proposed 2. Provisions for surface drainage 3. Landscaping and planting 4. Sidewalks, sidewalk widths, etc. 5. Existing features to remain such as street and sidewalk on the north Because of surface water drainage problems in this area it is quite important that adequate planning for this be considered. Adjacent structures should be shown to determine the affect-on neighboring proger- ty. The Village ordinance requires l.5 parking spaces be provided for each dwelling unit.. Therefore at least 27 spaces are required, however experience has shown that this is not always adequate. Minimum size by ordinance for a parking space is 9' wide and 20' long. Some spaces shown on this plan are for parallel parking. For the average full size car a 24' length is required for ease of parking. The layout as presented leaves no space for snow removal and storage, therefore in the winter the parking lot would decrease in size and force residents to park elsewhere. Parking on Larpenteur Avenue is discouraged. Almost 50~ of the spaces shown are too small. Mr. Jurgenson has indicated that they would like to make the nine spaces on the east garages. Experience again has shown that people tend to park in the garage only in bad weather. Other times they park in someone elses parking spot thus decreasing the capacity of the park- ing lot. Ordinance calls for a land area of 1500 square feet per single bedroom apartment. Therefore by ordinance 27,000 sq. ft. are required. This total area is only 25,818 leaving a deficit of 1,182 sq. ft. You will note that there is no area for recreational purposes for the residents. In addition to the building outline shown on the plat plan there are balconies that project out an additional 5 feet on all sides. The roof also projects 5'-6" over all sides of the building. Mang apartment buildings being built today provide means of plugging in automobile engine heaters. This would be quite difficult in this case. Parallel parking on the west side would be undesirable to the neighboring property because of aesthetic reasons. Footings shown for thebuilding are not frost depth footings. It is felt that this is important in our climate... No storage areas are provided for the residents. No laundry room or utility area is provided. No basement is provided. The Uniform Building'Code would require a stairway to the roof, and several other items o£ construction .that are not herein included. It is our opinion that the owner is attempting to crowd too much onto the limited space. available. Facilities. shown on the plans are 'not consistent with the quality, design and aesthetics of the existing adjacent properties.. If approved as shown the project could cause future problems to the Village.. It is recommended that because of the inadequate plan, especially as shown on the. plat plan that this permit not be granted, It appears that a smaller building with less .units could better fit the property and enhance the area. Consequently I am writing you so that my ideas may be considered at the meeting as I feel rather strongly on the sub3ect of the fence around 7r. Olson's }~ws.nuning pool. First and most important, I think the Village should approve his request for a variance. I do not think the fence is an eyesore. In fact it isn't as close to the street as the fence next door to 1800 Snelling, which may be con- sidered a back yard fence for a house on Asbury, but which is really much closer to the street than Dr. Olson!s fence. A friend of mine who bu~lt.a swimming pool in another state tells me that most insurance companies require at least a six foot fence around pools. My feeling is that , if anything, Dr. Olson should make the fences on the sides the same height as in the front. By doing this, he would be more assured that children wouldn't come in uninvited, and the appearance would be better as one drives down Larpenteur. At present, it is a little un- sightly to have two different heights visible. The request has been reviewed in conjunction with the existing zoning ordinances of the Village. In addition traffic counts were made in the general area in an attempt to assess the nature and volume of the existing traffic. Plans that were submitted by the owner were checked as to utility services, physical set-backs, street access and other features. Existing sewer and water lines were found to be correct as shown on the plans submitted and it was also determined- that these facilities are adequate to satis- factorily serve the proposed facilities if the project were to receive the approv- al of the Council. Set-backs on the proposed building are within the limits established in the zoning ordinance. The fence as shown along the south property line adjacent to the alley could prove a detriment because of snow problems in the winter, Since this facil- ity abuts R-1 residential property it would be desirable to screen the proposed facility, however the proposed fence will cause a snow trap and in addition make plowing of the alley quite difficult since there would be no snow storage space along the entire length of the fence. The location proposed for this facility is at the intersection of two heavily traveled streets. Observation of comparable facilities has shown that during the cold months of the year a considerable amount of water vapor escapes in the form of fog or steam each time the doors open. Because of the close proximity of the proposed facility to the alley and the streets this problem could possibly be a detriment to vehicular safety. The additional traffic generated by the proposed facility could also cause a problem on the two heavily traveled streets. The existing entrance on the north- east corner of the property is already too close to the intersection since~a - 1 - r _r Village Council May 28, 1970 Falcon Heights, Minn. 55113 Re: File No. 6044 vehicle cannot exit onto Hamline Avenue through this ramp without blocking lanes, causing a problem with traffic turning onto Hamline from Larpenteur and also missing the signal detectors on Hamline. This is a serious point of potential vehicle conflict and could cause a serious accident. At times of heavy usage the traffic could possibly be cuased to back up onto both streets. Although the plans submitted show .a number of vehicles in proposed stocking places if the station area were filled as shown no traffic could move since gas pumps, parking spaces, etc. would be blocked. If the permit was approved we would recommend closing the north ramp on Hamline and requiring very strict turning monuments controlled by signs on the other two ramps. Random traffic counts were made on east bound and west bound lanes on Larpenteur and on both the north bound and south bound lanes on Hamline. These wer simply. random counts taken with an hourly recording counter. The counts were not related to any traffic survey to obtain yearly average daily traffic (ADT) but were rather to obtain some information on a random day for study purposes. The tapes from these counts are available in our office. The average traffic on the east bound lane of Larpenteur for the two days counted in May was 10,176 vehicles per day. Average west bound on Larpenteur taken in the same manner was 7,249 vehicles per day, however, this was taken on a Saturday and Sunday whereas the eastbound counts were on a Thursday and Friday. The average count of two days on the southbound lane of Hamline was 2,908 vehicles per day. Because of vandalism the traffic count on the northbound lane was ruined. Additional counts will be taken if so desired. On the particl count obtained it appeared that there were between 100 and 150 vehicles per hour during the daytime period with a peak of .386 vehicles per hour shown at 5:00 P.M. In reviewing the preceding figures it is felt that the additional traffic generated by the proposed facility could only be a detriment to the traffic now contained on the streets since every vehicle entering or leaving would cause a slowup in the traffic pattern and thus delay or reduce the number of vehicles passing through the signalized intersection during each signal cycle. The preceding information is given at the request of the Village Council based on our studies and review. Study should be made by the Village Planner. It is our opinion that the proposed facility would cause difficulties in the present street traffic pattern. The fence could cause difficulties along the alley. Although set-backs and other features are within limits shown in the ordinance it is felt that this facility if .approved would prove detrimental both because of traffic problems and because of the close proximity to R-1 residential property. SUBJECT: Request for conditional use permit for car wash facility at the southwest corner of the intersection of Hamline and Larpenteur Avenues. A review of the plot plan submitted to our office by Mr. Peter H. Seed of Briggs and Morgan, prepared by Northwest Design, Inc. and dated 6-1-68 has been reviewed relative to adjacent land use development, zoning, and street patterns. As you are well aware of at the present time, the site in question is utilized for a service station. The site is zoned in a proper classification to facilitate the use of the property for a service station. Adjacent land uses, particularly to the south and west of the site are presently zoned R-1 c, single family res'sdential development, and developed for such purposes. Due to the intensification of the land use on the proposed site by the inclusion of a single bay automatic car washing facility and furthermore relating such intensification of use to existing traffic patterns within the immediate vicinity of the site, it is our conclusion that the granting of a conditional use permit for the car wash on this site would not be a reasonable course of action. Development of the car wash in conjunction with the service station on this site would create additional traffic problems at the intersection of Hamline and Larpenteur Avenues. The only possible solution to this traffic problem would be the closing of the driveway entrance onto the site at the far north- east corner of the property on Hamline Avenue. Furthermore, denial of the conditional use permit would not create the situation of denial of substantial right and property since there is presently existing on the site a valid and justified use in terms of the zoning district provisions. The Planning Commission met at the Village Hall on Monday, Mary 11, 1970 at 7:30 P.I~i. to consider I~ir. Magnusonts request for a conditional use permit. Mr. Magnuson plans to make a parking space next to his 231 wide driveway. The parking space will be 20' by 10'. It is set back 9' from the curb on Garden Street, is parallel to the curb and perpendicular to the driveway. The parking area will be made of bricks set in sand. The parking area is bisected by the lot line. In other words half of it is on the boulevard. Mr. Magnuson says he is making the parking area of impermanent materials so that if a sidewalk is ever built along Garden, his parking area can come out to males coon for the sidewalk. The Plannir~ Co~nni.ssion saw two problems with Mr. Magnuson's plan: 1. Because the area is bisected by his lot line, his vehicles will be parked partially on the boulevard. 2. The construction of the parking area in this location would be in conflict with section 14.2 (3.1) of Ordinance 64. However, because there is no sidewalk there at present and because Mr. Magnuson agrees that his parking area would have to be removed if a side- walk were to be built, the Planning Commission recommends to the Village Council that they grant a variance request to Mr. Magnuson for the construc- tion of his parking area. (The Planning Commission considers this a variance rather than a conditional use.)
