MINUTYS <br />CITY COUNCIL <br />F);BROARY 9, 2005 <br />LaValle asked about the opportunity for additional days during the peak <br />sunvner months. Siemers reported that summer is when the demand for <br />the crews is at its highest. IIowever, if there may be a few extra days here <br />and there that would be available. <br />Blesener asked if any inmate with drug convictions have been required to <br />complete a treatment program. Siemers replied that in most cases they <br />have. Keis asked what would be the biggest problem the City could <br />expect. Siemers reported that their biggest problem is cigarettes. <br />Cigarettes are not allowed in the prison facilities, and inmates are not <br />allowed to smoke. If an inmate is caught smoking ou a work crew, they <br />are sent back inside. Siemers reported that it is a privilege for the inmates <br />to be on a work a'ew. They are doing something productive and are paid <br />well when compared to other prison jobs. Siemers reported that when the <br />inmates are waking and making money, they are also able to pay back <br />restitution and fines. <br />131esener asked if the crews work five days per week. Siemers reported <br />that they work four 10 hor~u' days. <br />The City Administrator noted that the contracC can be cancelled with 30 <br />days notice. He asked if payment is made in advance and the City cancels, <br />whether a refund would be made. Siemers replied that a prorated refund <br />would be made to the City. <br />The City Attorney indicated that he had only two issues with the contract. <br />The first was relative to refunds if the contract is cancelled. The Attorney <br />was satisfied with Mr. Siemers response relative to prorated refunds The <br />second issue had to do with liability and the City Attorney suggested that <br />the language of Section 6 of the contract be expanded. Siemers repotted <br />that he has some other language that was used iu the past which he would <br />be happy to provide to the City Attorney. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOI UTION NO. 200.5-2-35 -APPROVING THE CONTRACT <br />W/TH.S~TATE OF MINNESOTA, /N.S~%7TUTION C(IMMUNITY <br />WORK CREW 1'12OCrRAM, SI113.ILCT 1'0 REVIEW AND APPROVA7, <br />OF THE C7T3'ATTORNEI' RELATIVE TO I,ZA137T ITYLANGUA(iE <br />OF THE CONTRACT, AND AUTHORIZING THE MAYOR AND <br />CITI'ADMINI.STRA%'OR TO EA'ECUTE T]]E CON'!'RACT ON <br />131THALF OF THE CITI' <br />The foregoing resolution was duly seconded by Deis. <br />Ayes (5) LaValle, Keis, Montour, Blesener, Allan. <br />Nays (0). Resolution declared adopted. <br />
