MINUT)JS <br />CITI' C®UNCIL <br />APRIL 27, 2005 <br />not cooperate in this regard, the CiCy can abate the nuisance, have the <br />property cleaned up, and the cost assessed against the property. The <br />Administrator reported ChaC he and the Code EnforcemenC Officer have <br />been discussing the abatement option with the City ACCOrney, and there are <br />some difficult issues related to this option given that most of the cars on <br />the property are not owned by Mr. Winner. <br />The City Administrator reported that there is also interest by Slumberland <br />as well as Steve Garske in purchasing the property. Slumberland has had <br />the property appraised and has made an offer to Mr. Winner. Mrs. Winner <br />was initially unaware of the situation, and has been informed of past <br />efforts as well as additional enforcement options that the City has. <br />The Administrator reported that at Che present time the City Attorney is <br />working with the Sheriff's DeparCment to obtain a warrant to inspect the <br />property from a life safety/fire hazard standpoint. <br />Blesener asked about eminent domain. The City Administrator replied <br />that this is another option thaC the City has. The Administrator reported <br />that code enforcement efforts will not let up on this property until the <br />problems are resolved. <br />With regard to other properties in the City, the Code Enforcement Officer <br />indicated that citations will be issued to Valor Enterprises as well as <br />Precision Tree relative to long-standing code enforcement issues. <br />LaValle raised the issue of temporary signs, and the Council reviewed <br />pictures of three signs that LaValle questioned. The Code Enforcement <br />Officer noted that the signs are properly licensed. However, the Studio <br />Nails temporary sign exceeds the maximum size requirements given the <br />extension of the top and bottom of the sign. This will be addressed and <br />the sign size brought into compliance. <br />Montour asked if Che Code Enforcement Officer had any issues with the <br />sign ordinance. She replied that one issue is that the sign ordinance does <br />not allow for temporary garage sale signs. The Code Enforcement Officer <br />indicated that she would be proposing an ordinance amendment to allow <br />for temporary garage sale signs on the days and times of the sales. <br />With regard to the Studio Nails sign, LaValle objected to the use of neon <br />colors on these signs. Council discussed Chis concern, and the consensus <br />was to not place restrictions on the colors that could be used. <br />The City Administrator asked if the Council had any concerns with the <br />City's code enforcement practices and philosophy.
