MINUTT/S <br />CITY COUNCIL <br />AUGUST 10, 2005 <br />of the existing site at 515 Little Canada Road East, referenced in <br />the lease dated March 8, 1989 between the City of Little Canada <br />and New Cingular Wireless as successor in interest to A T & T <br />Wireless and Cellular One. <br />If said lease dated March 8, 1989 is terminated and the tower at <br />3250 Spruce Street is to provide coverage previously provided by <br />antennas at 515 Little Canada Road East, then the applicant would <br />be in violation of Section 903.140 (D), and the CUP will be <br />terminated. Applicant agrees to remove said tower within 120 <br />days." <br />Weiss reported that she will present this language to New Cingular acrd <br />felt that it would be acceptable to them. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by LaValle, seconded by Allan, the public hearing was <br />closed. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2005-8-175 - APROVING THE CONDITIONAL <br />USE PERMIT TO ALLOW THE CONSTRUCTION AND <br />OPERATION OF A MONOPOLE WIRELESS COMMUNICATIONS <br />TOWER AND EQUIPMENT SHELTER AT 3250 SPRUCE STREET <br />SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS <br />OF THE PLANNING COMMISSION AND THE CITY PLANNER AS <br />OUTLINED IN HIS REPORT DATED MAY 6, 2005, AS WELL AS <br />SUBJECT TO THE FOLLOWING: <br />Approval of the CUP for the new proposed tower Zoeated at 3250 <br />Spruce Street shall not in any way replace the coverage objective <br />of the existing site at 515 Little Canada Road East, referenced in <br />the lease dated March 8, 1989 between the City of Little Canada <br />and New Cingular Wireless as successor in interest to A T & T <br />Wireless and Cellular One. <br />If said lease dated March 8, 1989 is terminated and the tower at <br />3250 Spruce Street is to provide coverage previously provided by <br />antennas at 575 Little Canada Road East, then the applicant <br />would be in violation of Section 903.140 (D), and the CUP will be <br />terminated.
