Hanson <br />The City previously granted approval to an agreement between the State of Minnesota and the <br />City that provides for the receipt of grants funds made available through State General <br />Obligation Bonds as provided by the legislature in 2014. We were granted $1,250,000 of bond <br />funds to upgrade our six at -grade railroad crossings. <br />MnDot, as the oversight agency, has made a number of revisions to the previous draft of the <br />agreement that require Council action. They are also asking we adopt a resolution that addresses <br />the following requirements: <br />• A reference to the state statute that gives you the legal authority to enter into the <br />agreement with MnDOT and with the Railroad - section 5.04(c.) of the grant agreement. <br />• Commitment of any local funds to fully fund the project - section 5.04(D) <br />• A statement that the city agrees to fund any maintenance requirements over the 20 -year <br />bond period if the railroad does not fulfill their commitment to perform maintenance (per <br />the agreements between the city and the railroad) section 5.04(J) <br />• That the city's insurance meets the requirement under section 6.01. <br />• That the city agrees to cover any costs that exceed the amount of funds provided by the <br />state (bond plus federal) necessary to complete the projects.- section 5.04(p) <br />A resolution is attached to fulfill MnDot's requirements. Also attached is the revised grant <br />agreement for your review. The City of Shoreview adopted a similar resolution at their July 20th <br />meeting with the exception that they do not have a matching funds requirement. <br />Staff recommends approval of the attached resolution as presented. <br />1 <br />
