MnDOT Agreement #06820 <br />GENERAL OBLIGATION BOND PROCEEDS <br />GRANT AGREEMENT <br />CONSTRUCTION GRANT <br />for the <br />CITY OF LITTLE CANADA TO REPLACE ACTIVE HIGHWAY -RAIL GRADE <br />WARNING SAFETY DEVICES THAT HAVE REACHED THE END OF THEIR <br />USEFUL LIFE AND TO DESIGN, CONSTRUCT, AND EQUIP HIGHWAY RAIL <br />GRADE CROSSING WARNING DEVICES AND ASSOCIATED SAFETY <br />IMPROVEMENTS <br />PROJECT <br />THIS AGREEMENT shall be effective as of _and is between City of Little Canada <br />Minnesota a statutory city, (the "Grant Recipient"), and the Minnesota Department of <br />Transportation (the "State Entity"). <br />RECITALS <br />A. Under the provisions contained in Minnesota Laws of 2014, Chapter 294, Section 16, <br />Subd 5 and as amended by Minnesota Laws of 2015 1st Special Session, Chapter 5, Article 3, <br />Section 13 (the "G.O. Bonding Legislation"), the State of Minnesota has allocated <br />$1,250,000.00 (the "Grant") which is to be given to the Grant Recipient as a grant to assist it in <br />the design, construct, and equip highway rail grade crossing warning devices and associated <br />safety improvements as authorized by such legislation; and <br />B. The monies allocated to fund the grant to the Grant Recipient are proceeds of state <br />general obligation bonds authorized to be issued under Article XI, Sec. 5(i) of the Minnesota <br />Constitution; and <br />C. The Federal Highway Administration, when acting in cooperation with the State of <br />Minnesota, is authorized by Title 23 of the United States Code to make Federal Aid available for <br />the purpose of eliminating hazards at railroad grade crossings within the State of Minnesota; and <br />D. The State, pursuant to Minnesota Statute Section 161.36, is authorized to cooperate <br />with the United States Government and any agency or department thereof in the construction, <br />improvement, enhancement and maintenance of transportation in the state of Minnesota and <br />may comply with the with the provisions of the laws of the United States and any regulations <br />made thereunder for the expenditure of federal moneys; and <br />E. The State, pursuant to Minnesota Statute Section 219.26, has reviewed the proposed <br />selection of warning devices for the railroad grade crossing and has determined that the proposed <br />selection is appropriate for said crossing; and <br />Little Caanda GO Bond Proceeds Grant Agreement Ver— 5/06/15 <br />for MnDOT Antiquated Equipment Grants 8 <br />
