MnDOT Agreement #06820 <br />inconsistency between the following additional requirements and any other provisions or <br />requirement contained in this Agreement, the following additional requirements contained in this <br />Section shall control. <br />The project will include six new railroad signals with gates at the following crossings: <br />1. Woodlyn Avenue (DOT # 689015V, RR MP 13.11) <br />2. South Owasso Drive (DOT # 689016C, RR MP 13.33) <br />3. Little Canada Road (DOT # 689018R, RR MP 13.37) <br />4. Demont Avenue (DOT # 689021Y, RR MP 14.42) <br />5. County Road B2 (DOT # 689022F, RR MP 14.67) <br />6. County Road B ( DOT # 689025B, RR MP 15.19) <br />The property is owned by the Soo Line Railroad Company doing business as Canadian <br />Pacific Railway (Company). The highway -rail grade crossing signal devices provided for <br />in this agreement shall be owned by the City of Little Canada and will be maintained and <br />operated by the Company upon completion of its installation. The obligation to maintain <br />the signal system will continue in accordance with the law of the State as it shall be from <br />time to time in the future. <br />This agreement is funded in part by federal funds. The Grant Recipient will comply with all <br />applicable federal laws and regulations including but not limited to those outlined in Electronic <br />Code of Federal Regulations, Title 2, Appendix II to Part 200—Contract Provisions for Non - <br />Federal Entity Contracts Under Federal Awards. "Exhibit A" contains these provisions, which is <br />attached and incorporated into this agreement. <br />Nondiscrimination. If the Grant Recipient enters into a contract with a contractor, to perform all <br />or any portion of the Grant Recipient's work set forth in this Agreement, the Grant Recipient for <br />itself, its assigns and successors in interest, agrees that it will not discriminate in its choice of <br />contractors and will include all of the nondiscrimination provisions in this agreement and as set <br />forth in "Exhibit B" attached hereto and made a part hereof. <br />Buy America. The requirements of the "Buy America" provisions in 23 U.S.C. 313 and 23 CFR <br />635.410 are applicable to this Agreement. If the Grant Recipient uses steel or iron as part of its <br />work, and the cost of that steel or iron is more than 0.1 percent of the total project cost or $2,500 <br />(whichever is greater), Grant Recipient must use steel or iron melted or manufactured in the <br />United States. Materials that have been removed from the United States for any process (e.g., <br />change of chemical content, shape, size, or finish) are not considered domestic materials. The <br />Buy America Memorandum which lists Grant Recipient requirements, "Exhibit C", is attached <br />and incorporated into this Agreement. <br />Disadvantaged Business Enterprise. The disadvantaged business enterprise requirements of 49 <br />CFR 26, apply to this Agreement. The Grant Recipient will insure that disadvantaged business <br />enterprises as defined in 49 CFR 26, have the maximum opportunity to participate in the <br />performance of contracts, financed in whole or in part with federal funds. In this regard, the <br />Grant Recipient will take all necessary and reasonable steps in accordance with 49 CFR 26, to <br />insure that disadvantaged business enterprises have the maximum opportunity to compete for and <br />Little Caanda GO Boncl Proceeds Grant Agreement Ver— 5/06/15 <br />for MnDOT Antiquated Equipment Grants 3 7 <br />
