MINUTES PLANNING CONID~IISSION MARCH 11, 2004 Notion carried 5 - 0. PROPERTY Greg 7luhler, representing St John's Church, appeared before the COMBINATION Commission requesting the combination of the former N(aryhouse & REZONING - property with the St. John's Cemetary property into one loC. Tnihler 450 LITTLE also requested approval of the Rezoning of the former Maryhouse CANADA ROAD - property from Single-Family (R-1) to Public (P). Titiihler reported ST. JOI3N'S that St. John's will continue to use the two houses on the property CIIURCI3 as they are currently being use, one is a rectory and the other a shelter for women and children in crisis. The purpose of the request is to ensure that the property stay under Church ownership given the long-teen need for additional cemetery space. I3owever, the homes will continue to be used as they currently are until that the use of the homes is no longer feasible. I{eis asked about the non-conforming status mentioned in the City Planner's report. The City Planner indicated that the residential use would be considered along-term non-conformity and the goal would be that these homes not return to market residential property. Weihe asked about the ability to make improvements to the homes. The Planner indicated that the Code allowed some limited expansion of non- conforming residential uses as well as mahitenance improvements. I-Iowever, if the banes were destroyed by over 50% of their value, the Code would not allow the homes to be reconstructed. The Planner noted, however, that there is currently pending legislation that would require cities to allow reconstruction of anon-conforming home. I{eis recommended approval of the Property Combination of the Former iv![aryhouse property with the St. John's Cemetary property into one parcel as well as a Rezoning of the former Nlaiyhouse property from Single- Pamily Residential (R-1) to Public (P) as requested by St. john's Church subject to compliance with the recommendations of the City Planner. VARIANCE 7esse Anesi, Aldi roods, appeared before the Commission requesting a FROM SIGN Variance fran the Sign Ordinance to allow two building signs plus one ORDINANCE- pylon sign for Aldi foods at 2350 Rice Street.
