08/26/15 <br />DEVELOPMENT CONTRACT <br />THIS AGREEMENT, MADE THIS day of , 2015, by and between the <br />City of Little Canada, a municipal corporation of the State of Minnesota (hereinafter referred to <br />as the "City") and Roger Berres, a single person, hereinafter referred to as "Owner". <br />WITNESSETH: <br />WHEREAS, Owner is in title to the property located at 2955 & 2957 Arcade Street, <br />hereinafter "The Property", situated in the City of Little Canada, County of Ramsey, State of <br />Minnesota. The legal description of The Property is as follows: Subject To Road & Easements; <br />The S 75 Ft Of The N 2094.81 Ft Of E 191.4 Ft Of Lot 13, Auditor's Subdivision No. 43. <br />WHEREAS, The Property was granted a conditional use permit on October 28, 1981 <br />for construction of a two family home. <br />WHEREAS, Owner lives in one of the units at The Property (2957 Arcade). <br />WHEREAS, Owner acknowledges that he allowed the "duplex" status of The Property <br />to lapse for over one year from the period of December of 2012 to June 30th, 2014 as is <br />documented by the City's letter to Owner attached hereto as Exhibit A. <br />WHEREAS, Owner has appealed the lapsed use determination to the Little Canada <br />Board of Adjustment and Appeals based on his letter received by the City on June 22, 2015 and <br />attached hereto as Exhibit B . <br />2 <br />
