Hanson <br />In September 2005, Joe's Sporting Goods was granted an Interim Use Permit that allowed their <br />store two outdoor display areas for recreational equipment. At that time, the Council issued the <br />permit for two years and set an expiration date of December 31, 2007. This permit was renewed <br />in 2007 for another two years and then again in 2009 for a five year period. That last renewal. <br />was through December 31, 2014. These renewals were approved based on Joe's Sporting Goods <br />continued compliance with the permit conditions (it should also be noted that staff has not <br />received any complaints). 1 have included with this memo the diagram Joe's Sporting Goods <br />submitted with their previous and current application showing the display locations. <br />Joe's Sporting Goods continues to have the need for outdoor displays of recreation equipment as <br />such the request has been made to renew the permit that expired on December 31, 2014. There is <br />a slight modification to the site plan from the previous submittals for the display areas. The store <br />no longer sells trampolines which is what was previously on display in Location B. As a result, <br />their merchandise on display is set up differently. This renewal is for three display areas that <br />would still comply with the ordinance requirements. The building wall facing Hwy 36 labeled <br />Location C is now smaller than the previous Location B facing Hwy 36. In addition, they've <br />added a display area to the front of the store only visible to customers corning into the store. <br />This area will be used to display taller tree stands (pictures included). Lastly, this 1UP renewal <br />request is once again for a five year permit. That would make the permit valid until December <br />31, 2019 (that includes this year as part of the five years as if no lapse in time). <br />City staff feels it is also necessary to point out that this permit does not include any approval for <br />deviation from the temporary sign ordinance. Joe's Sporting Goods is still subject to conditions <br />and applicable permits listed in City Code 903.110. <br />Based on Joe's Sporting Goods continue compliance, city staff recommends approving the <br />renewal of their Interim Use Permit for five years with an expiration date of December 31, <br />2019 subject to compliance with the IUP conditions listed in B-3 zoning district. <br />
