MINUTES <br />PLANNING COMMISSION <br />MAY 13, 2004 <br />Duray recommended approval of the Conditional Use Permit for <br />Residential PUD to allow variance in side yard setbacks for Hidden Acres <br />subject to compliance with the recommendations of the City Planner, and <br />subject to a PUD Agreement and the recording of Covenants on the <br />Hidden Acres lots addressing this Residential PUD. <br />Motion seconded by Knudsen. <br />Motion carried 6 - 0. <br />AMENDMENT Knudsen noted that the Planning Commission tabled action last fall <br />TO CUP AND on the request of Valor Enterprises for an Amendment to Conditional <br />VARIANCE - Use Permit to modify their site plan as well as a Variance from the <br />3165-3167 City's parking requirement. These matters were tabled in order to <br />SPRUCE give the property owner time to have an engineering study done of the <br />STREET - property relative to drainage. Knudsen noted that the applicant has <br />VALOR not submitted that drainage report. Knudsen pointed out that when the <br />ENTERPRISES matter was initially before the Commission, it was explained that a <br /> hardship must be present in order to warrant granting a variance. It was <br /> also noted that a hardship cannot be economic in nature, thus the matter <br /> was tabled in order to give the applicant an opportunity to have the <br /> engineering study done. <br />Lori Peterson, Valor Enterprises, indicated that they have submitted a <br />revised site plan to address storage issues. Peterson indicated that she <br />thought the parking issues were already agreed upon, allowing the switch <br />in locations of the sales lot with the overflow parking area. <br />Knudsen indicated that no action has been taken on the Amendment to <br />CUI' for site plau revisions or on the Variance request. Both matters were <br />tabled so that the applicant could have his own engineering study done in <br />an attempt to refute the City Engineer's study of the site drainage. <br />Knudsen pointed out that the City Engineer's conclusion was that site <br />drainage could be improved with some filling and grading. Knudsen <br />pointed out that the property owner has submitted nothing that refutes that <br />finding. <br />Fred Sedaghat, Valor Enterprises, reported that the City Administrator and <br />the Code Enforcement Officer recently visited his site and indicated that <br />he did not submit the information he was required to. Sedaghat reported <br />that he had dropped off a revised site plan at the City Center. Sedaghat <br />indicated that the Code Enforcement Officer called him the next day and <br />indicated that she found the revised site plan. <br />-7- <br />
