holding a leasehold interest in the property may also use the fair market value of the property for real <br />estate tax purposes as determined by the City Assessor in the year the license is first issued for <br />determining whether the initial investment requirement has been satisfied. The Council may provide <br />for an independent appraisal at applicant's expense, as an aid in determining the investment or the <br />value of said business. In the event this requirement as to investment is not complied with within <br />one year from the date of issuance of the license, the license may be revoked or suspended. <br />(2) Building Area. A restaurant building containing a minimum of 1,500 square feet used <br />for seated dining purposes, including the bar area but excluding the area used for kitchen, storage, <br />restroom facilities, waiting areas, and entrance and exit purposes. <br />(3) Seating Capacity. A restaurant building having appropriate facilities and adequate <br />staff to serve meals at tables and, for seating not less than 90 guests at one time for meals, including <br />seating available for food service in the bar area but excluding seating in a lounge or waiting area. <br />(4) Maximum Liquor Sales. The sale of intoxicating liquor, wine or 3.2 percent malt <br />beverages shall not exceed 40 percent of the restaurant's gross yearly sales. Evidence of compliance <br />with this requirement shall be furnished by licensee with annual renewal information submitted to <br />City. <br />7113.035. MINIMUM STANDARDS FOR "ON -SALE RESTAURANT -EVENT CENTER" <br />INTOXICATING LIQUOR LICENSE. The following requirements must be satisfied prior to the <br />issuance of an "On -Sale Event Center" intoxicating liquor license. <br />feet. <br />(1) Building Area. An event center building shall have a minimum of 10,000 square <br />(2) Full -Service Kitchen. An event center shall have a full-service kitchen equipped <br />with adequate personnel, equipment, and food to prepare meals. For purposes of this ordinance, an "Event" shall be no more than eight <br />(8) hours and shall not be open to the public. There shall be no more than one hundred four <br />(104) Events in each calendar year. Events held on the same day by different customers shall be <br />considered to be separate Events for purposes of calculating the maximum number of annual <br />Events. The sale, service, or consumption of intoxicating liquor shall only be permitted during <br />an Event provided Paragraph (2) of this section is met. <br />(5) The event center shall not advertise the sale of intoxicating liquors anywhere on <br />703-2 <br />
