515 Little Canada Road, Little Canada, MN 55117-1600
(651) 766-4029 / FAX: (651) 766-4048
www.ci.li ttle-canada. mn.us
MEMORANDUM
TO: Mayor Keis and Members of the City Council
FROM: Joel Hanson, City Administrator
DATE: October 20, 2015
RE: LMCIT Liability Coverage — Waiver Form
MAYOR
John Keis
COUNCIL
Rick Montour
Michael McGraw
Tom Fischer
Christian Torkelson
ADMINISTRATOR
Joel. R. Hanson
The Council must decide if it wishes to continue to not waive the City's statutory tort limits for
liability coverage. By not waiving our statutory tort limits, we are telling the League of
Minnesota Cities Insurance Trust that any claims where statutory limits of liability apply will be
governed by those limits, i.e. $500,000 per person and $1.5 million of liability coverage. (These
limits have been increasing the past number of years in an attempt to prevent them from being
legally changed.)
Also, in 2015, LMCIT increased the liability limit to those potential claims not covered by
statutory limits of liability to $2,000,000 (Federal civil rights claims are one example). This
provides the City with more protection than existed in past years.
Staff would recommend continuing our practice of not waiving our statutory tort limits.
