MINUTES <br />PLANNING COMMISSION <br />APRIL 8, 2004 <br />developed with a street connecting Burke Lane and Yorkton Ridge, all the <br />new traffic will utilize Yorkton Ridge because the corner at Burke Lane is <br />horrific. Apish felt that given the property values that Mr. Howe is <br />projecting, the $140,000 that the Condit Street property owners want for <br />the connection to Condit Street should not prevent that connection from <br />occurring. <br />Howe reported that the swate has been eliminated from the plan. As a <br />result, the trees that back up the Yorkton Ridge lots will remain. The only <br />trees that will be removed will be those in the way of the building pads. <br />Duray asked what the road length would be if a cut-de-sac was put in from <br />Condit. Howe reported that the cul-de-sac length would be approximately <br />700 feet and the City's Code provides fora 500 foot maximum. <br />Barraclough asked about the easement into the Sam Fasciana property. <br />Howe replied that he had C.I. Title research this issue, and they found that <br />the driveway easement was not properly recorded, therefore, does not exist <br />of record. Therefore, in order to provide for two accesses into the <br />property to be developed, street connections from Burke Lane and <br />Yorkton Ridge are being proposed. <br />ICeis noted that ideally access would come from Condit Street. ICeis <br />stated, however, that he did not support a long cul-de-sac as the means to <br />develop the property and agreed that it should be developed with a through <br />street. <br />Howe indicated that if the City wants a connection to Condit Street, it will <br />have to use eminent domain. Howe stated that he was not willing to pay <br />the asking price that the two property owners on Condit Street want. <br />Nancy Walstead, Yorkton Ridge, stated that without the connection to <br />Condit Street all the traffic will utilize Yorkton Ridge. Walstead stated <br />that this will be a safety issue for the people living on Yorkton Ridge. <br />David Miller, Condit Street, noted that his property abuts the proposed <br />Hidden Acres development. He reported that he has had no discussion of <br />finances with Mr. Howe in terms of hard dollars for the right-of--way to <br />Condit Street. Miller felt it would only be fair that he was compensated <br />for the impact that an extension to Condit Street would have on his <br />property. Iv1i11er pointed out that as his property exists now he would have <br />two lots facing Condit. Putting the right-of--way through will eliminate his <br />ability to subdivide his property. Miller also pointed out the impact of his <br />property becoming a corner lot and having traffic along his side yard. <br />Miller indicated that his preference would be to negotiate with the <br />-7- <br />
