The original CUP was granted
for the purpose of allowing automobile sales and the outdoor storage of vehicles and
pares.
The applicants are seeking the amendment to allow the relocation of the sales area
from the rear of the property to the front of the site along Spruce Street. The relocation
of the sales lot would displace 16 of the originally required parking spaces. The staff
report, written in response to that application, estimated a required parking supply of 30
spaces. Under the proposed amendment, just 14 spaces would remain. The applicant
is seeking the variance to reduce the parking siapply r"rom 30 spaces to 14.
A part of the applicant's objection ~ tc the original permit relates to drainage issues on the
site. The applicant contends that the sales area of the property is subject to flooding,
and the for-sale vehicles must be moved to a better location. i !e also suggests that the
business is no longer a sales operation -they wish to accept vehicles for general repair
on a "retail" basis -repairing cars t'or ::utside customers instead of resale only. The
applicant indicates a need to accommodate up to 150 ~iehicles for this activity.
Conditional Use Permit
There are several conditions attached to the original permit. that were not complied with.
These include violations of the !imitations on autdoor storage: failure co pave the parking
and sales lot areas, and paving of area ,hat was ~ equired to be green space. The
applicant has suggested that he should be relieved of these conditions .because 1; his
