MINUTES PLANNING COMMISSION JULY 8, 2004 COMPRE- The City Planner indicated that a Comprehensive Sign Plan is required HENSIVE for The Lodge given that the prope~~Yy is zoned PU'D. He reviewed the SIGN PLAN - proposed sign plan submitted by Sherman Associates and indicated that TI3E LODGE the total square footage proposed is well under what is allowable under the City's ordinance requirements. The Planner recommended approval of the Comprehensive Sign Plan for The Lodge. Keis recommended approval of the Comprehensive Sign Plan as proposed for The Lodge. Motion seconded by Wojcik. Motion carried 5 - 0. VARIANCE Andy Loeffler, Dudley & Smith, appeared before the Commission relative & CUP - to the request for a Variance to allow outdoor storage in excess of Code 50 SOUTH limitations and an Amendment to Conditional Use Permit to modify the OWASSO site plan to reflect additional outdoor storage as well as accessory BLVD. - structure for wood-burning heating system for Precision Tree at 50 South PRECISION Owasso Blvd. Loeffler indicated that there are three issues relative to the TREE Precision Tree request, specifically the use of wood chips on the site, the heating source, and the outdoor storage. With regard to these issues, Loeffler indicated that there were hardships relative to each. For the outdoor storage, Loeffler indicated that it was not economically feasible to construct a building to store materials inside. For the alternative heat sow~ce, Loeffler indicated that Precision Tree is working with the manufacturer to heighten the smoke stacks to reduce the impact on the surrounding area. For the wood chips, Loeffler felt that the use of wood chips should be acceptable as they are a common landscape item and do not erode. Based on these argwnents, Loeffler felt that the requested Variance was appropriate Loeffler indicated that in the event the City does not grant the Variance and moves to code enforcement, he would request that Precision Tree be given 60 days to come into compliance with the Code. Loeffler pointed out that the Groholski Family has recently had some difficult times given the recent unexpected death of Mr. Groholski's father. Loeffler also reported that the Precision Tree business is very busy right now given the Dutch >/hn problem. Therefore, they would like 60 days to bring the property into compliance. However, it is still their position that granting of a Variance would be appropriate. Keis noted that the granting of a Variance must be based on a hardship that is not economic in nature, but rather something unique to the land. -5-
