MINUTES <br />CITY COUNCIL <br />MARCH 24, 2004 <br />PROPERTY Mayor Fahey opened the continued Public Hearing to consider the <br />DIVISION & request for Property Division to subdivide a property into two lots and <br />VACATION - the Vacation of Fifth Avenue lying between McMenemy Street on the <br />2367 east and Morrison Street on the west. Fahey noted the report submitted <br />McMENEMY- by the Planner which outlines options for accomplishing the Mackin <br />MACKIN Family's goat to preserve the marsh area on their property. <br />PROPERTY <br />Tony Mackin reported that he has reviewed the Planner's report and the <br />five options listed for preservation of the wetland. Mackin reported that <br />they have decided to pursue Option 2 which would involve a deed <br />restriction being placed on the marsh area that would require preservation. <br />'Cherefore, they are now withdrawing their application for property <br />division. Ivlacl<in indicated, however, that they are still pursuing the <br />vacation of Fifth Avenue. <br />Anderson asked if a deed restriction can be placed on a portion of the <br />property. The City Planner replied that a deed restriction can be placed <br />over a portion of the property utilizing the specific legal description for the <br />property to be restricted. <br />There was no one else present from the general public wishing to <br />comment on this matter. <br />Upon motion by LaValle, seconded by Blesener, the public hearing was <br />closed. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2004-3-50 -VACATING FIFTHAVENUE LYING <br />73L'TWEEN MCMENEMI' STREET ON THE EA.S~T AND MORRISON <br />STREET ON THE WEST <br />The foregoing resolution was duly seconded by Anderson. <br />Ayes (5) Blesener, Anderson, Montour, Fahey, LaValle. <br />Nays (0). Resolution declared adopted. <br />Mackin noted the previous discussion relative to the City establishing a <br />Conservation District, and urged the Council to pursue the matter. Mackin <br />pointed out that green space is disappearing and felt that many people in <br />Little Canada are interested in preserving green space. <br />Fahey agreed that the City should address the issue of conservation on a <br />macro-basis.
