MINUTES <br />CITY COUNCIL <br />JULY 11, 2001 <br />EXECUTION OF NECE,&V"ARY DOCUAIEN7:N Bl' THE MAYOR, CITI' <br />ADIVIINI.NTRATOR, AND ACCOUNTING SUPERVISOR; <br />"APPROVING THE VOUCHERS <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) LaValle, Scalze, Montour, Anderson, Fahey. <br />Nays (0). Resolution declared adopted. <br />PITRINA PARK Mayor .Fahey noted the request of the Pitrina Park Townhome Association <br />REQUEST FOR that the City take over the maintenance of private cul-de-sacs. Fahey <br />CITY TO TAKE indicated that he has reviewed the association documents that were <br />OVER PRIVATE provided to buyers. Fahey indicated that the documents clearly establish <br />CUL-DE-SACS the ownership of the common areas including the cul-de-sacs and reference the <br />duties of the townhome association relative to maintenance of these common <br />areas including the cul-de-sacs and driveways. Fahey stated that he is satisfied <br />that there was no misrepresentation or non -disclosure on the part of the sellers <br />to the buyers. <br />Fahey further noted the information obtained by City staff relative to policies <br />that other cities may have adopted regarding the taking over of private streets. <br />He noted that except where there are significant public safety concerns or <br />where it can be shown that the streets and setback meet city standards, cities <br />are not taking responsibility for maintaining private property. <br />Fahey commented on the issue of fairness raised by the Pitrina Park <br />Townhome Association and noted that fair does not always mean equal. Fahey <br />pointed out that there are many property owners who pay for City services that <br />they may not realize the benefit of. For example, properties abutting County <br />roads do not benefit from City tax dollars that are spent for plowing City <br />streets. There are also large apartment complexes in the City with long <br />driveways that must be maintained by the owners of the apartment complexes. <br />Fahey suggested that if the City took over the maintenance of the private cul- <br />de -sass in Pitrina Park, other townhome associations and apartment complexes <br />with private streets would make the same request. Fahey noted that Council's <br />recent change in policy that resulted from the development of Park View Court <br />townhome development, that townhome complexes will not longer be accepted <br />with private streets. <br />Montour noted that most cities do not have a standard policy for handling <br />requests to take over private streets. Montour asked if that was something the <br />Council wanted to consider adopting. <br />
