Hanson <br />RE: Questions Concerning Property Violations at 2708 Edgerton — Jack Schmidt & <br />Jay Dacey <br />Mr. Sclunidt and Mr. Dacey have requested to appear in front of the City Council to discuss their <br />concerns with the property at 2708 Edgerton. I believe they may want to take issue with how the <br />City has enforced the Rental Housing Ordinance against the property owner given issues with the <br />tenant. Accoirunodate <br />Given the threat of litigation, I have asked the City Attorney to be present at Monday's meeting <br />to assist with this discussion. In discussing this matter with him, he cautioned that we may not <br />be able to have a very specific discussion due to the concerns about litigation. He may also want <br />to have us moved to a closed session at the end of the regular meeting to update you on the <br />current status of this issue and to discuss other possible actions. <br />The Council should also be aware that the tenants of 2708 Edgerton have sought a restraining <br />order against Mr. Sclunidt and Mr. Dacey (they are the neighbors on each side of the property). I <br />understand that the judge initially denied the request, but a hearing process will still result. <br />To help familiarize you with our enforcement options in the rental housing ordinance, I'm <br />enclosing the appropriate sections (the entire ordinance is available on-line if you feel that is <br />more useful). Staff will be prepared to discuss the steps we have taken and our rationale for <br />same if deemed appropriate by you and the City Attorney. <br />cc: City Attorney <br />Jack Sclunidt <br />Jay Dacey <br />
