MINUTES <br />CITY COUNCIL <br />NOVEMBER 10, 2004 <br />GERVAiS 'Che City Administrator reviewed an Addendum to the Grading <br />73ILL5 Permit for the Gervais Hills development which will allow <br />DEVELOP- utility work to occur prior to execution of the full 'Development <br />MENT Agreement. The Administrator noted that the utility work will <br />AGREEMENT be subject to approval of the City Engineer and other permitting agencies <br />such as the PCA and Health Department. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2004-I1-280 -APPROVING THE ADDENDUM <br />TO GRADING PF,RMI%' FOR GIRVALS FALLS A.S <br />RECOMMENDED BI' THE C1TI'ADR47NhSTRATOR, SU73JECT TO <br />REVlEWANDAPPROVAI KY THE CITI'ATTORNEY,AND <br />AUTHORIZING THE CITYADMINISTRATOR TO EXECUTE ON <br />13EIFA7_F OF TFIE CIT I' <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4) Fahey, Blesener, Montour, Allan. <br />Nays (0) Resolution declared adopted. <br />FALL The Public Works Director indicated that given the lateness of the <br />STREET season, he is withdrawing his recommendation to proceed with a <br />SWEEPING Fall street sweeping. He noted that the goal would be to have a Fall street <br />sweeping occur earlier in the year so that ]eaves, sand, and dirt can be <br />removed from the City's streets before it washes into the storm sewer <br />system. <br />Council concurred with the recommendation, but urged the Public Works <br />Director to put a program in place so that a FaII street sweeping happens <br />on a routine basis. <br />COUNCIL The City Attorney indicated that he reviewed the League of <br />APPOINTMENT ,Minnesota Cities Handbook information that the City <br />PROCESS Administrator had relative to the Council appointment process. He noted <br />that this information references a 1986 Attorney <ieneral opinion that <br />indicated that a majority vote of the quorum present is sufficient in making <br />au appointment The Attorney indicated that he would have to review that <br />opinion in its entirety, but it was his opinion from the information <br />available tonight, that a simple majority of the quorum present at a <br />meeting would be sufficient to make an appointment For example, if four <br />Council Members are present and the vote is two votes to one vote to one <br />vote, the applicant receiving two votes would be appointed. <br />
