MINUTES <br />CITY COUNCIL <br />JANUARY 22, 2003 <br />Warehouse (B-W). The Council denied that request because they felt that <br />the use was not the highest and best use for this property. Fahey felt the <br />outdoor storage use being proposed at Sinclair was not a proper use for the <br />location. Rezoning the property to accommodate the outdoor storage <br />would be spot zoning. Fahey stated that he would not support such a <br />rezoning, and felt there were even less compelling reasons to allow the <br />outdoor storage on this property than there were under the Boat & Motor <br />Mart proposal. Fahey asked about the Comp Plan zoning designation for <br />the area. <br />The City Planner indicated that the Comp Plan does not designate zoning, <br />but rather use. The Comp Plan indicate that the area should be used <br />commercially, and the B-3 zoning that is in place is consistent with that <br />designation. The Planner also reviewed the history of the Council's action <br />in changing the B-3 Zoning District by eliminating gas stations and <br />convenience stores from that zone. The Sinclair Station use is <br />grandfathered in at this time. <br />Blesener indicated that he had two concerns. The first is that the U-Haul <br />truck storage would not be screened from the Gopher Electronics building. <br />The second is that it is typical to see U-Haul trucks stored in the front of <br />the property and the trucks themselves used as advertisements/signage. <br />Belsheh stated that he could control the location of the trucks and does not <br />need them for advertising purposes. <br />Fahey commented on the long history of code enforcement issues related <br />to outdoor storage. He pointed out that while Mr. Balsheh may do a good <br />job screening the trucks, the next operator of the Station tray not. Fahey <br />also expressed concerts about the precedent that would be set and the <br />desire of other gas station/convenience stores to do the same thing, <br />Anderson indicated that he appreciated the improvements that Balsheh has <br />made to the property. He expressed concern that this was a busy <br />intersection, and first-time truck drivers in and out of the Sinclair Station <br />may be a problem. <br />Balsheh stated that he could limit the number of trucks to one or two and <br />screen them behind the building. He assured the Council that he would <br />control the situation. <br />Montour felt that a U-Haul rental business would be a good addition to the <br />City, but felt that this was not the right location for it. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />10 <br />
